R77-10 03-28-77RESOLUTION NO.R77-10 A RESOLUTION AUTHORIZING FUNDS FOR PARTICIPATION IN THE HOUSTON-GALVESTON AREA COUNCIL'S PROJECT FOR UPGRADING THE OPERATING EFFICIENCY OF REGIONAL LAW ENFORCEMENT AGENCIES WITH THE ACQUISITION OF TELECOMMUNICATIONS TERMINALS; AND PROVIDING THAT THIS RESOLUTION SHALL BE EFFECTIVE UPON AND AFTER ITS ADOPTION. WHEREAS, Pearland wishes to participate in a Houston -Galveston Area Council project designed to improve law enforcement by upgrading the operating efficiency of regional law enforcement agencies with the acquisition of new, improved high speed video (CRT) telecommunications terminals to replace the existing teletype units and add new subscribers on Texas' Law Enforcement Telecommunications Network (TLETN), and; WHEREAS, it is recognized. that Criminal Justice Division funding is available to those units of government who agree to accept the lawfully promulgated rules and regulations for administration of grants so funded, and; WHEREAS, Pearland is desirous of obtaining Criminal Justice Division funding of a portion of the purchase price and first year's maintenance cost of the new terminal, and; WHEREAS, Pearland recognizes that the portion of the purchase price and first year's maintenance cost required to be paid by Pearland will be an amount not to exceed ($3,984.30), and that subsequent years' maintenance costs will not be funded by the Houston -Galveston Area Council nor the Texas Criminal Justice Division, and that those subsequent years' maintenance costs are contractually guaranteed at ($105.00) per month, ($1,260.00) per year, until January, 1982, and; WHEREAS, an agency receiving equipment under the project will be required to provide a suitable site for the equipment to include a sturdy table or desk for the equipment to be placed upon and an electrical circuit providing for three (3) 115 VAC electrical outlets, within five (5) feet of the physical location of the terminal, three -prong, grounded, type capable of providing up to five (5) amperes of current to each of the three (3) outlets. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: That Pearland consents to and authorizes the Houston -Galveston Area Council to submit a grant application to the Criminal Justice Division and to execute a contract with International Communications Corporation (ICC) for the purchase and maintenance of one (or more) high speed video (CRT) terminal devices. That Pearland agrees to pay the cash commitment required to partici- pate in the project and that Pearland will cooperate with the Houston -Galveston Area Council and International Communications Corporation to set up a billing and payment procedure that will allow for a smooth transition when the funded project expires after 12 months; and, agrees to continue the operation of funded equipment, using locally budgeted funds, for the law enforcement or Criminal Justice purposes for the useful life of the equipment. That Pearland certifies by adoption of this resolution that the City of Pearland meets one of the following eligibility conditions for participation in this project: (a) Replacement of an existing terminal or teletype already on the Texas Law Enforcement Telecommunications Network, or; (b) Has 24 hour, 7 days per week, dispatching with one or more people on duty to operate radio and terminal equipment,or; (c) Has at least 18 hour dispatching, 7 days per week and has 10 full-time commissioned and certified police officers or deputies, not including the Chief of Police nor other City officials who may be commissioned and/or certified, or; (d) Has at least 12 hour dispatching, 7 days per week and is the only terminal equipped law enforcement agency within a 50 mile radius and is willing to serve as an inquiry point for all other law enforcement agencies in the immediate vicinity. Amok Item #2, Page 1 FUNDING CRITERIA GRANT REQUIREMENTS Local Units of Government SITE PREPARATION OPTIONS Funding Criteria and Grant Requirements For Highspeed Landline Terminals . r • FUNDING CRITERIA To obtain funding for highspeed terminal equipment in agency must qualify under ONE of the below listed criteria: 1) Replacing an existing .terminal or teletype already on the Texas' Law Enforcement Telecommunications Network (TLETN) . 2) Have 24 hour, 7 days per week, dispatching (dispatching is defined as having one or more people on duty to operate radio and terminal equip- nent.) 3) Have at least 18 hou'r dispatching 7 days per week and have 10 full-time commissioned and certified police officers or deputies. (Agencies qualifying under this criterion may not include the chief of police or sheriff nor other city or county officials who may be commissioned and/ or certified, e.g. , city manager, director of public safety, assistant city manager, etc. • • • 4) Have at least 12 hour, 7 days per week, dispatching and be the only terminal equipped law enforcement agency within a 50 mile radius and be willing to serve as-an inquiry point for all other law enforcement agencies in the immediate vicinity. .. 5) Demonstrate that more than 96 messages are presently being generated per day by the department. 6) Police or sheriffs departments which can demonstrate justifiable and documented reasons that require a TLETN terminal. Each request under this criterion must be fully documented to justify the acquisition, and such request should include information on hours of dispatching, number 1.1 of officers served, amount of current traffic, geographic and demo- ' graphic peculiarities, other agencies served, and all other factors which convincingly indicate, and document, a clear need for the terminal • NB unit. • • GRANT REQUIREMENTS • All funded units of local government must: . 1) Participate in the DPS/FBI Uniform Crime Reporting Program, 2) Certify compliance with Security and Privacy Regulations,' 3) Certify that the agency will continue tie terminal maintenance after the first (funded) year of operation, 1 lh Item #2, Page 2 4) Insure that new operators will be trained in terminal operating pro- cedures before being assigned the duties as terminal operator, 5) Insure that all terminal operations will be in compliance with the • current rules and procedures covering the TLETN, TCIC, NCIC, NLETS systems. 6) Execute a resolution agreeing to participate in the project, commit- ing the necessary local cash to the project, and allowing the regional planning unit to contract for equipment delivery on behalf of the governmental entity. 7) Submit resolutions documenting the local government compliance to funding criterion (number 2,3, or 4) if such compliance has not already been accomplished. • NIP • • • • • Item #2, Page 3 Highspeed Landline .
