A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
PEARLAND, TEXAS, AUTHORIZING THE MAYOR TO EXECUTE
A CONTRACT BY AND BETWEEN THE CITY OF PEARLAND
AND THE PEARLAND VOLUNTEER FIRE DEPARTMENT.
BE IT RESOLVED by the City Council of the City of Pearland
Texas, that the Mayor be, and he is hereby authorized to execute
for and in behalf of the City of Pearland a contract by and
between the City of Pearland and the Pearland Volunteer Fire
Department regarding the extinguishing of accidental or destructive
fires and preventing the occurance or spreading of such fires.

THIS AGREEMENT made this 23- day of January ,' 1978
by and between the City of Pearland, a municipal corporation, of
the State of Texas, herein called "City" , and the Pearland Vol-
unteer Fire Department, a non-profit volunteer organization of
Pearland, Texas , herein called "Fire Department" , in consideration
of the undertaking of the parties hereto unto each other.
WITNESSETH
1. . Term of Agreement. This agreement shall be in full
force and effect beginning on the. 23 day of January , 1978 ,

and shall remain and continue in full force and effect from year
to year thereafter unless one of the parties hereto notifies the .
other in writing that it elects to reopen this agreement for the
purposes of renegotiating certain provisions thereof, which shall
be enumerated in the communication, or for the purpose of negotia-
ting new and additional provisions, which also shall be enumerated
in the communication. Upon receipt of such notice of election,
parties will immediately arrange to enter into negotiations with
respect to the requests contained in said notice.
2 . Function. It is mutually agreed by and between the
City and Fire Department that it shall be the function and duty
of the Fire Department and every member thereof to extinguish
accidental or destructive fires and to prevent the occurrence
or spread of such fires within the corporate limits of said City.
The Fire Department shall also attend to salvage. and rescue
operations associated with fires and/or fire disasters within
said City and to any and all emergencies normally performed by
a Volunteer Fire Department.
3. By-Laws, Rules, and Regulations. It• is mutually
agreed that, the Fire Department shall 'adopt its own by-laws and
shall have independent authority to adopt, enforce and promulgate

any reasonable rules and regulations governing its members and
the use of any and all fire department facilities. The Fire
Department shall have suchother and further rights and powers .-,
as is provided by ordinances of the City of Pearland or statutes
of the State of Texas. .
4. Compensation. It is mutually agreed that no member
of the Fire Department shall receive any salaried compensation
from the City of Pearland for services rendered with the exception
of such consideration and reimbursements that may be provided
the Fire Department from time to time by resolution by the Mayor
and City Council.
5. Budget. The City agrees to allocate each year
such funds for the use of the Fire Department as are shown on.
the budget approved by the City Council. The Fire Department .
shall prepare an allowance budget for each fiscal year, and shall
submit such budget to the City Council for approval not less
than two (2) months prior to the commencement of the City' s
fiscal or budget year.
6 . Insurance. The Fire Department agrees to maintain
and keep in force at all times Public Liability insurance and
an accident and death benefit insurance policy, or policies,
providing insurance coverage for all members of the Fire Depart-
,
ment, and shall maintain and keep in force at all times good
and sufficient bonds, as may be required from time to time, for
all or individual members of the Fire Department. Premiums
for the said insurance and bond shall be paid for and be the
responsibility of the Fire Department. .
7 . Retirement. The City agrees to allocate, each
year, such funds as are necessary for the active members of Fire
Department to participate in the Fire Fighters' Relief and Retire-
ment Fund as passed on August 28 , 1977 by the Texas Legislature
and known as Senate Bill 411. Such allocation to .be based on a
•ra-te. of --$12 00 per month per firefighter. .
The Secretary of the Department shall . submit a list
naming the active members of the Department to the City Manager
each January, April, July, and October.

Department agrees to transfer all of its right, title and
interest in and to all vehicles and fire fighting apparatus
presently held and in its possession to the City and further to
timely execute all documents necessary to consummate and finalize
said transfers.
The City agrees, upon said transfer, to assume total
responsibility for all insurance coverage onthe said vehicles
and apparatus and to pay all insurance premiums in connection
with said coverage.
In this connection it is understood and agreed that the
Fire Department shall retain possession of and responsibility
for that certain Brazoria County pumping unit presently assigned
to said department and shall provide and pay for all insurance
coverage on said County unit.
9. Service outside Corporate Limits. It is mutually
agreed that the Fire Department shall have the right and aut-
hority to go outside the corporate limits of the City for the
purpose of rendering aid to other Fire Departments, or of ex-
tinguishing fires or rendering aid in the case of accident.
Provided, that the Fire Department shall not render such service
outside the corporate limits excepting upon orders of the Chief
of the Fire Department or his Assistant Chief.
10. Laws. It is agreed by the Fire Department that
in addition to the by-laws and rules and regulations as may be
established by the department, the laws of the State, ordinances
of the City, and federal laws pertaining to and affecting fire-
men shall be governing factors in the conduct of all members
of the Fire Department, who shall at all times be subject to the
same.

LETTER FROM MARVIN SETZER
The Pearland Volunteer Fire Department has no ob'jection to let-
ting the people in our ETJ decide on whether or not to form a
"rural fire prevention district." We do object to Mr. Setzer's
opinion that the Pearland Volunteer Fire Department cannot pro-
vide fire protection to the ETJ. The PVFD has provided fire
protection, as well as rescue services, very effectively, I might
add, to the entire community for quite some time and will contin-
ue to do so.

Re:
Whether the Fire Marshall must be a certified
Peace Officer in order to hold that office.
Dear Mr.Wicker:
Pursuant to the request of the council, I am writing this
opinion regarding the issue of whether or not the fire marshall
for the City of Pearland needs to be a certified peace officer in
order to hold that office. A check of Article 212 of the Texas
Code of Criminal Procedure, which sets out who are peace offi-
cers, there is no mention of fire marshall. The only mention is
anyone who is a member of an arson investigation unit of a city,
county, or state. Therefore, the only person who must be a peace
officer is an arson investigator and arson arson inspector.
There is no .prohibition for a private citizen regardless of
whether he is certified by the Texas Fire Commission or the Texas
Commission on Law Enforcement Standards and Education, in order
for that person to be the fire marshall. The only other place to
look is in the City of Pearland Code of Ordinances, Chapter 10,
which sets out the qualifications for the fire marshall. The
only qualification is that the person shall be properly qualified
for the duties of his office in accordance with recognized
standards. There are no recognized standards at this time.
During my investigation I was able to determine that there
is presently.being held hearings in Austin before the, Texas Fire
Commission regarding setting standards for a fire marshall. I
suspect that the Texas Municipal League will inform us of such
legislation and I am sure that we can obtain a copy of the
proposed standards should it be requested.
Furthermore, there is no provision in the Code of Ordinances
of the City of Pearland for an assistant fire m~rshall. In the
event that .the City,Manager wishes to appoint an assistant fire
marshall, that office should be created by amending Chapter 10 of
the Code of Ordinances, City of Pearland.
Furthermore, under Section 10-23 of the Code of Ordinances
of the City of Pearland, it is the duty of the fire marshall to
investigate fires. The fire marshall could possibly be in
violation of not being licensed as an arson investigator if he is
to carry out Section 10-23 of the Code of Ordinances. The way in
which he does not have to do .this is if he has an arson inves-
tigator and that is the person to which he has delegated such
authority.

Enclosed is the new agreement between the City oF Pearland and the
Pearland Vohmteer Fire Department which supersedes all previous contracts
and aRreements with your organization.
Please note that Paragraph 7, Retirement, has been added and that
this section places responsibility on the Fire Department's secretary to
submit a list oF the active members to me in January, April, July and
October. I Feel that this is necessary because it is the intent of the
law and the City Council to make this retirement benefit available to the
active Fire Department members only.
It was also discussed and decided between Councilman Itarry Farley,
representing the City Council, and Chief Doyle Granad, representing the'
Fire Department, that the City would no longer'provide the $5.00 credit
towards the active Department members utility bill since the retirement
compensation applied to all firemen regardless of residence, and the
utility bill credit could only be applied to the bills oF the Firemen:.
residing in the city limits.
Please execute this Agreement at your earliest convenience, retaining
one copy For the Fire Department files, and return the other to the City
Secretary.
