R86-26 10-13-86RESOLUTION NO. R86-26 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, AUTHORIZING THE CREATION OF A NON-CIVIL SERVICE CLASSIFICATION, TO BE CALLED "ASSISTANT CHIEF", AUTHORIZING THE CHIEF OF POLICE TO APPOINT ONE PERSON TO SUCH POSITION, AND PROVIDING AN EFFECTIVE DATE. WHEREAS, Vernon's Annotated Civil Statutes, Article 1269m, Section 8A(b), provides that if the City Council approves by Resolution or Ordinance, the Chief of Police may appoint each person occupying authorized positions in the classification immediately below that of Chief, as outlined within said Section 8A; and, WHEREAS, four classifications currently exist, to-wit: Lieutenant, Sergeant and Patrolman, below the classification within the Pearland Police Department; and, Captain, of Chief WHEREAS, on January 1, 1983, there was one (1) person serving in the classification then immediately below that of the Police Chief, which would allow for the appointment of not more than two (2) persons by the Chief of Police to positions in the classification described in said Section 8A; and, WHEREAS, Robert Riemenschneider, whose 1986, to create the non-civil Chief" and to appoint one it is the desire of newly appointed Pearland Police Chief appointment takes effect October 20, service classification of "Assistant person to a position within such classification, which classification would be immediately below that of Chief of Police in the chain of command within said Department; and, WHEREAS, the City Council is of the opinion that the creation of such classification and the appointment of one person to a position within such classification is in the best interests of the City; now, therefore, 1 BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: THAT the City Council does hereby in all things affirm and ratify the creation of the non-civil service classification of "Assistant Chief" immediately below the classification of Chief of Police within the Pearland Police Department, and does hereby further in all things affirm and ratify the appointment of one (1) person to a position in such classification by the Police Chief, as permitted under Section 8A(b) of Article 1269m, Vernon's Annotated Civil Statutes; and, THAT Police Chief Robert Riemenschneider, whose appointment will take effect on October 20, 1986, is hereby specifically authorized to make such appointment; and, THAT this Resolution shall upon the installation of the Riemenschneider, on October 20, be in full force and effect immediately newly appointed Police Chief, Robert 1986.
