A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PEARLAND,
TEXAS, ACCEPTING THE PROVISIONS AND PROPOSAL OF MINUTE
ORDER NUMBER 86090, PASSED AND APPROVED BY THE STATE
DEPARTMENT OF HIGHWAYS AND PUBLIC TRANSPORTATION ON JULY
29, 1987.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND,
TEXAS:
The City of Pearland, Texas, by the adoption and passage of this
Resolution, does hereby accept and agree to the terms and provisions
of Minute Order 86090 passed by the State Department of Highways and
Public Transportation of the State of Texas, on July 29, 1987, a copy
of which is attached hereto and made a part of this Resolution for all
purposes as Exhibit "A."
That the Mayor and City Secretary are hereby authorized and
directed to execute and deliver any and all documents and to do any
and all other things necessary and convenient to carry out the terms
of this Resolution or Minute Order Number 86090.
III.
That this Resolution shall take effect

MEMO, in BRAZORIA, GALVESTDMAND HAIR'S COUNTIES, local
officials have requested construction of a facility known as the
"Galveston-Alvin-Pearland Parkway" to extend from Beltway 8 near State
Highway 35 south to the intersection of State Highway 35 and Loop 409
south near Farm to Market Road 1462 (hereinafter referred to as the
Northern Portion), then south and southeast to Galveston Island near
Jamaica Beach (hereinafter referred to as the-Southern Portion); and
ES, it is understood that the GalvestonnAlvin.Pear].and
Transportation Corporation has been created to assist in the
development of various aspects of the project as directed by the State
Highway and Public Transportation Canission (the "Ccomission") and has
offered to provide One Hundred Percent of the right of way and utility
adjustments and assist in the planning of the project; and

31, 1987 tendered to the Cities of Alvin and Pearland and to Brazbria
and Harris Counties designating a State Highway and authorizing project
development to include any necessary agreements; and

Provided the Cities and Counties on the Northern Portion will:
1. Concur and cooperate in the development of the project as
outlined herein.
The State Department of Highways and Public Transportation will:
1. Provide project planning on the Northern Portion, including
but not limited to: Route studies, environmental reports,
schematics, and determination of right of way requirements.
Upon acceptance of the provisions of this order by the Cities
of Alvin and Pearland and by Brazoria and Harris Counties, IT IS
ORDERED that a STATE HIGHWAY be and is hereby designated extending from
Beltway 8 near State Highway 35 south to the intersection of State
Highway 35 and Loop 409 south near Farm to Market Road 1462, than south
and southeast to Galveston Island near Jamaica Beach, a distance of
approximately 43 miles, such highway to be and is designated as
controlled access for development, maintenance and operation in
accordance with the provisions of House Bill 179, 55th Texas
Legislature; and the Engineer-Director is directed to proceed wi
project development to include any necessary agreements, right of way
acquisition, utility adjustments, and relocation assistance.

This authorization is for project plan development for the
Northern Portion, but should not be considered as authorization or
construction funding. However, after One Hundred Percent of the right
of way has been acquired, and utility adjustments have been completed
by the Galveston-Alvin-Pearland Transportation Corporation,
authorization for stage construction will be considered based on the
availability of funds and statewide priorities.
That portion of State Highway 35 south of Beltway 8 to a
junction with Loop 409 and State Highway 35 north of Alvin, which was
designated by Minute Order 60213, dated November 28, 1967, is hereby .
canceled.
Minute Order 63415 dated February 23, 1970 which authorized the
realignment of State Highway 35 is hereby canceled.
It is understood that on the Southern Portion from the
intersection of'State Highway 35 and Loop 409 south near Farm to Market
Road 1462 southeast. to Galveston Island near Jamaica Beach, the
Galveston-Alvin-Pearland Transportation Corporation by separate Minute
Order will be authorized to perform additional feasibility studies
including the consideration of alternative methods of financing.
This Order shall become operative upon acceptance by the Cities
of Alvin and Pearland and by Brazoria and Harris Counties; and if not
accepted within 90 days of the date hereof, the action herein contained .
shall be automatically canceled. -
