R88-09 02-22-88RESOLUTION N0. R88-9 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, ESTABLISHING THE RUN-OFF ELECTION DATE FOR REGULAR AND GENERAL ELECTIONS TO BE HELD IN THE CITY; AUTHORIZING THE CITY ATTORNEY TO APPLY FOR PRECLEARANCE FROM THE DEPARTMENT OF JUSTICE FOR SAID RUN-OFF DATE; AND HAVING AN EFFECTIVE DATE. WHEREAS, the laws of the State of Texas provide that on the first Saturday in May, a Regular and/or General Election shall be held within the City; and, WHEREAS, because the City of Pearland Mayor and City Councilmembers serve for terms of three years, and because such officials must obtain a majority of the votes cast to be elected, according to the City Charter, requiring the City to hold a run-off election when candidates have not received a majority of the votes cast in such Regular and/or General Election; and WHEREAS, the Mayor and City Council must, by resolution or ordinance, establish either the last Saturday in May or the next-to- last Saturday in May as the official run-off date for such elections; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: THAT the official run-off date for City Regular and/or General Elections held on the first Saturday in May shall hereafter be the next to last Saturday in May; and THAT the City Attorney is hereby authorized to apply for pre- from the U. S. Department of Justice for such run-off date; clearance and THAT this Resolution shall be in full force and effect from and after its passage on first and only required reading, and shall remain in full force and effect from year to year until specifically repealed by resolution or ordinance of the City Council.
