A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PEARLAND,
TEXAS, AUTHORIZING THE MAYOR AND EACH COUNCILMEMBER TO
EXECUTE, ON BEHALF OF THE CITY, A SUPPLEMENTARY AGREE-
MENT WITH THE STATE DEPARTMENT OF HIGHWAYS AND PUBLIC
TRANSPORTATION FOR THE CITY'S PARTICIPATION IN THE
IMPROVEMENTS OF FM 518 WITHIN THE CITY.
WHEREAS, The City of Pearland and the State of Texas through
the State Department of Highways and Public Transportation entered
into an agreement, dated March 11, 1988, that, among other things,
provided for the construction of curb, gutter, storm sewer and
incidental items within the limits from 1.1 miles east of State
Highway No. 35 to 0.2 mile northwest of Galveston County Line on FM
518, estimated cost Two Million Two Hundred Seventy Seven Thousand Two
Hundred Thirty One and 55/100 Dollars ($2,277,231.55), and the City
to make such payments in four installments;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PEARLAND, TEXAS:
THAT the Mayor and each Councilmember shall be and are hereby
authorized to execute on behalf of the City the attached Supplementary
Agreement with the State that provides that the City's share shall be
a fixed amount of Two Million Two Hundred Seventy Seven Thousand Two
Hundred Thirty One and 55/100 Dollars ($2,277,231.55) and that the
State will pay all costs in excess of this amount. It is further
resolved that all other conditions as set forth in the agreement
between the City and the State, dated March 11, 1988, shall remain in
full force and effect.
THAT this Resolution shall be in full force and effect from and
after its passage on first and only required reading.

THIS SUPPLEMENTARY AGREEMENT, made. this 14 day of June , 1988,
by and between the City of Pearland, Texas , hereinafter called the "City" ,
Party of the First Part, acting by and through its City Council and the
State of ,Texas, hereinafter called the "State", Party of the Second Part
acting by and through its State Highway and Public Transportatioi
Commission.
WHEREAS, an agreement, dated March 11, 1988, entered into by anri
between the City and State, among other things, provided for the
construction of curb, gutter, storm sewer and incidental items within thle
limits from 1.i miles east of State Highway No. 35 to 0.2 mile northwest of
Galveston County Line on Farm to Market Road No. 518, estimated to cost T o

55/100 Dollars ($2,277,231.55) , and the City paid the State upon executi n
an incremental amount of Five Hundred Sixty Nine Thousand Three Hundred
Seven and 89/100 Dollars ($569,307.89) , which was deposited to the Stae
Department of Highways and Public Transportation, and
WHEREAS, subsequent to the receipt of bids it has now been determinfd
that the City's share is to be a fixed amount of Two Million Two Hundred
Seventy Seven Thousand Two Hundred Thirty One and 55/100r Dollars
($2,277,231.55) .
NOW THEREFORE, it is understood that this supplementary agreement

Two Hundred Seventy Seven Thousand Two Hundred Thirty One and 55/10
Dollars ($2,277,231.55) , and the State will pay all costs in excess of thi
