R89-11 4-10-89 FAILEDRESOLUTION NO. R89-11 A RESOLUTION EXTENDING THE MORATORIUM ON THE IMPACT FEES ON THE CAPITAL IMPROVEMENTS PLAN FOR THE CITY OF PEARLAND, TEXAS AND PROVIDING FOR SEVERABILITY. IMPOSITION OF WHEREAS, pursuant to Ordinance No. 471, adopted the 9th day of April, 1984, the City Council authorized the imposition of capital maintenance and recovery fees for the purpose of defray- ing future capital costs for construction and maintenance of distribution, transmission, and treatment facilities for water and sanitary sewers; and WHEREAS, in accordance with and pursuant to said Ordinance No. 471, the City Council did, by motion, adopt a fee schedule for recovery of capital maintenance and recovery costs; and WHEREAS, by virtue of Article 1269j-4.11, Texas Revised Civil Statutes, adopted by the 70th Legislature, Regular Session, 1987, the City Council has found it necessary and appropriate to adopt a new capital improvements plan and capital recovery fee schedule to comply with the provisions of said Article 1269j- 4.11; and WHEREAS, the City Council has implemented an impact fee schedule by Resolution on October 10, 1988 to be effective April 10, 1989; and WHEREAS, the moratorium on the therefore BE IT RESOLVED TEXAS: Section 1. by Resolution No. 1989 City Council now desires to extend the implementation of the impact fees; now BY THE CITY COUNCIL OF THE CITY OF PEARLAND, The implementation of the R88-30 which were to is hereby extended until PASSED, APPROVED and RESOLVED this 1989. impact fees approved take effect on April 10, , 19 day of , TOM REID, MAYOR CITY OF PEARLAND, TEXAS ATTEST: KAY KROUSE, CITY SECRETARY CITY OF PEARLAND, TEXAS ROBERT E.
