AND ZONING COMMISSION OF THE CITY OF PEARLAND, TEXAS, HELD ON

If. PURPOSE OF HEARING — APPLICATION NO. 959
Request of owners for an amendment to the Land Use and Urban Development
Ordinance of said City from classification Suburban Development District (SD) to
Commercial District (C) on the following described property, to wit:

proposed zone change.

III. PERSONS WISHING TO SPEAK FOR THE PROPOSED REQUESTS
Mikey Mackey, 6625 FM 1960, Houston, TX, stated that he would like to speak in
proposal for Zoning Application No. 959. He stated that he would like to present a set
of pictures of some other structures on Roy Rd. He briefly went over each individual
picture. He then stated that it would not be suitable to continue the growth of the area
with residential. He then stated that the fair market value of the property is $100,000,
and if the zoning would be changed to either "Commercial' or "General Business",
then the value could increase to $150,000. He stated that this could be a serious loss
to the owner. He stated that they are proposing a substantial improvement to the City
of Pearland and others around the area. He is not planning for this to be a "Beer Hall',
and he is planning for it to be a wedding reception hall. He stated that it could be used
for 400 people at a time. He stated that it will be an attractive brick structure, it will
have a garden, and a gazebo. He stated that it will be prettier then any other structure
on Roy Rd. He explained that they are originally asking for "Commercial" zoning,
however, after reconsidering the plans, he feels that this could fit in "General
Business" zoning.
IV. PERSONS WISHING TO SPEAK AGAINST THE PROPOSED REQUESTS
David Allen, 14010 Garden Rd, Pearland, Texas, stated that he is located behind the
property. He stated that he also brought a set of pictures to show the homes in the
area surrounding the property. He stated that he has a number of objections and
listed them as:
1. "Commercial" zoning is inconsistent with the large acre homes, and he
explained that past the medal buildings are the homes.
2. The requested zoning is the most liberal and least restrictive zoning allowed by
the City.
3. The increase of traffic.
4. No public water/sewer system.
5. The fact that parties/banquets occur later in the evening. He then stated that
Knights of Columbus has records for a number of complaints. He stated that
anyone can check with the Police Department or the Municipal Court for the
number of complaints.
Mr. Allen then referred to the number of accidents that have happened to in the past
on Roy Rd. He also stated that this would make this road very unsafe, and reminded
everyone that it is a two-lane road with no shoulders, and a deep ditch on the west
side.
Joe Lynn Brown, 2221 Roy Rd, Pearland, Texas stated that he has a 4,000 square
foot home and he has been there for 11 years. He stated that located across the
street is the Hickory Slough. He stated that if your off the road even two feet then your
in the slough. He pointed out that there have been 13 accidents between December
of 1999 and December of 2000, and those are only the ones that have been reported.
He stated that another concern is the increase in traffic this would cause. He stated

the developer calls this a "Community Hall", he on the other hand calls it a "Beer Hall".
He stated that he does not want this in his neighborhood, and he deeply encourages
City Council to disallow this to happen.
Roy Allison, 7118 Robin Sound, Pearland, Texas stated that he has a wife and child
that go up and down Roy Road 2 or 3 times a day, and Roy Rd is not lit up. He stated
that he is scared to death to have a beer facility near his home, and all he can see is a
911 video being made on Roy Road. He then pleaded with City Council not to put a
beer joint here, and that it would be horrible. He finally stated that there are plenty of
facilities now for that sort of thing in Pearland.
Michael Heflin, 7134 W. Cliffstone Rd, Pearland, Texas, stated that he has seen a
corvette turned upside down on this road. He also stated that he has 3.5 acres, a
large brick home, and he maintains his garden well. He is against the zone change.
Sandy Jenkins, 2137 Roy Rd, Pearland, Texas, stated that she is there to speak for
her and her husband. She explained that her property borders on 2 sides of the
proposed property and it will affect her family more than anyone. She stated that she
has lived there for 2 years, and they saved for 8 years to purchase the property. She
has a 3,000 square foot home and the asking price was $300,000, and now it is worth
much more. The hall would considerably decrease her property value. She stated
that she has 3 grandchildren, and they have horses. She stated that the whole
essence of living in Pearland was for having her grandchildren over to her house and
be comfortable. She stated that at this time they can go in the back and play in the
dark and she doesn't have to be worried about them, and that will all change if they put
this hall next to her property. She stated that she feels it would be extremely
dangerous to have a public facility next to her house. She also added that she never
received any of the questionnaires that were sent out.
Grady Allen, 2138 Garden Rd, Pearland, Texas, stated that he lives directly behind the
property and he is also there to represent the Adams. He stated that he lives in a
3500 square foot house. He stated his concern is the security for all of the children.
He also stated that he already has large guard dogs, and is unsure how they will act to
the bright lights and noise. He is also concerned about the drinking that will be going
on and the traffic.
Amy Moran, 2137 Roy Rd, Pearland, Texas, stated that she is there for herself and
her mother, Sandy Jenkins, who spoke earlier. She stated that her mother currently
has 7 acres with horses, and her children love it at their grandmothers. She also will
not feel safe with a banquet hall. She stated that she is very comfortable at this time
with the children being outside in the dark. She said that they also ride their bikes up
and down Roy Road, and she asking for her children's sake that this is not approved.
John Sullivan, 2230 Roy Rd, Pearland, Texas stated that he has a problem with the
traffic and he can tell everyone first hand about it. He stated that the road was
probably not designed for business. He stated that his house is about 3500-4000
square feet, and he has 10 acres in which he lets his friends graze their cattle. He
stated that the City has found him and annexed him, therefore he is urging City
Council to see that this is a residential area. He stated that he has a substantial
investment in his property.

Ben Norton, 2049 Roy Rd, Pearland, Texas stated that he is also there to speak for
Mrs. Francis Adams. He stated that he has lived there for 26 years, and Mrs. Adams
has been there a similar amount of years. They have enjoyed the residential living
conditions, and 2 years ago they were annexed. Since they have been annexed they
have been paying City taxes, and they would respectively request that City Council
deny this application.
Wendy Standorf, 7125 Robin Meadows, Pearland, Texas, stated that she is speaking
on behalf of several neighbors who could not attend the meeting. She stated that she
doesn't feel the road is suitable for this. She also pointed out to City Council that on
November 14, 1997 there was a Joint Public Hearing held for a property north of
Knights of Columbus for "General Business" zoning. She stated that there were
several homeowners in the area who came out and spoke in opposition due to noise,
traffic, and they were afraid of more people using their driveways as turnarounds. She
pointed out that this request was denied also. She finally stated that requested zoning
is also not consistent with the City's Comprehensive Plan.
Walter Hillin, 1610 Roy Rd, Pearland, Texas, stated that he is against the request and
it will decrease the value of his property. He lives in a nice neighborhood, and he does
not think this will be good for the area.
V. COUNCIL/PLANNING COMMISSION/ STAFF DISCUSSION
Mayor Tom Reid asked if this type of business requires "Commercial" zoning?
Manager of Administrative Support Tobin Maples stated that it could be permitted in
"General Business". He stated that restaurants are allowable in "General Business."
He stated that he even believes this could go down as low as "Neighborhood
Services."
Councilmember Larry Wilkins stated that he would like to confirm that staffs
recommendation is for denial, and Mr. Maples replied that he is correct.

III. PERSONS WISHING TO SPEAK FOR THE PROPOSED REQUESTS
Jon Volkmer, 2915 Bentley Ct, Pearland, Texas stated that he is there to represent the
owners of Pearland Golf Getaway, Zoning Application No. 957, Ed and Matilda
Maldanado. He stated that they have been residents of Silverlake since 1986 with
three sons. He stated that they are members of St. Helens Church and the Knights of
Columbus. They have 17 acres of land on Broadway that has been a golf driving
range many times. He stated that this is the fastest growing part of Pearland, and he
passed around a proposed layout of their.plans. He explained that the parking lot will
be set back 500 away from FM 518, and he pointed out that there is a new street light
at the entrance. He stated that he would like to point out as staff did that 17 residents
were notified and there have been no oppositions. He stated that he has known them
since 1986 and they are also members of the Pearland Hobby Chamber of
Commerce.

III. PERSONS WISHING TO SPEAK FOR THE PROPOSED REQUESTS
Richard Diese, 2952 Waterloo, Pearland, Texas, stated that he is representing the
owners of Zoning Application No. 954. He stated that they would like to subdivide the
property, and they are actually in the platting process. They are requesting R-1 for
large lots for some beautiful homes.
Hector Rios, future resident of Pearland, Texas, stated that he would like to build a
3,000 square foot home and he is in support of Zoning Application No. 954.
Larry Moser, 4014 Elmwood Dr, Pearland, Texas, stated that he is there on behalf of
himself and his brother who is a resident in the frame house next door, which was
shown on the slide presented by staff. He stated that his house is 2,200-2,400 square
feet, and he passed around pictures. He stated that he has lived there off and on his
whole life. He also pointed out that staff is in support of this request and he is in
support of Zoning Application No. 955.
Mary Riser, purchaser of 4634 Hughes Ranch Rd, Pearland, Texas, stated that she is
now a part of the City, and she is there in support of Zoning Application No. 954. She
stated that she has questions such as, is there any potential for city utilities, or fire
hydrants.
IV. PERSONS WISHING TO SPEAK AGAINST THE PROPOSED REQUESTS
None
V. COUNCIUPLANNING COMMISSION/ STAFF DISCUSSION
Councilmember Larry Marcott asked if the property owners were advised that they
now have "RE" which is estates size lots, and this would allow for bigger size lots.
Manager of Administrative Support Tobin Maples explained that typically when they
apply for the zoning staff should go over the various zoning allowable.
Planning and Zoning Commissioner Richard F. Tetens asked for staffs input on utility
availability.

Manager of Administrative Support Tobin Maples stated he does not have the master
plan on him but he does not that it is the City's policy that the water and sewer
extensions are supplied where areas are being developed.
Mayor Reid commented that for more details on the utilities they could meet with Mr.
Maples after the meeting or give him a call and he could explain further.
