2000-10-23 CITY COUNCIL AND PLANNING AND ZONING COMMISSION JOINT PUBLIC HEARING MEETING MINUTES141 MINUTES - JOINT PUBLIC HEARING OF THE CITY COUNCIL AND THE PLANNING AND ZONING COMMISSION OF THE CITY OF PEARLAND, TEXAS, HELD OCTOBER 23, 2000, AT 6:30 P.M., IN THE COUNCIL CHAMBERS, CITY HALL, 3519 LIBERTY DRIVE, PEARLAND, TEXAS A series of Joint Public Hearings was called to order in the Community Center at 6:36 PM with the following present: Mayor Tom Reid Mayor Pro -Tem ` Klaus Seeger Council Member Helen Beckman Council Member Larry Marcott Council Member Woody Owens P&Z Chairperson Mary Starr P&Z Commissioner Emil Beltz P&Z Commissioner Donald Glenn P&Z Commissioner Todd locco P&Z Commissioner Russ Selemon P&Z Commissioner Richard Tetens P&Z Commissioner Charles Viktorin Manager of Administrative Support Tobin Maples Secretary Mona Ann Phipps Zoning Application No. 948 1. CALL TO ORDER The Joint Public Hearing was called to order at 6:36 PM. 11. PURPOSE OF HEARING Request of owners for an amendment to the Land Use and Urban Development Ordinance of said City from classification Suburban Development District (SD) to Commercial District (C) on the following described property, to wit: Legal Description: 2 tracts totaling 6.564 acres in the James Hamilton Survey, A-881, Harris County, Texas (14007 South Freeway) Owner: St. Thomas of Canterbury Church 14007 South Freeway -1- 142 Houston, TX 77047 Agent: The Reverend James T. Payne Planning and Zoning Chairperson Mary Starr read the purpose of the hearing into the record. Manager of Administrative Support Tobin Maples explained that the Comprehensive Plan recommends Business Park uses for this area. He stated that this zone change request is compatible with the surrounding uses. 111. PERSONS WISHING TO SPEAK FOR THE PROPOSED REQUEST none IV. PERSONS WISHING TO SPEAK AGAINST THE PROPOSED REQUEST none V. COUNCIL/PLANNING COMMISSION/STAFF DISCUSSION Council Member Larry Marcott asked if the area just South of this had recently been rezoned. Manager of Administrative Support Tobin Maples stated that the property just South of this has recently been rezoned to Commercial. VI. ADJOURNMENT The Joint Public Hearing adjourned at 6:42 PM. Zoning Application No. 942 CALL TO ORDER The meeting was called to order at 6:42 PM. 11. PURPOSE OF HEARING Request of owners for an amendment to the Land Use and Urban Development Ordinance of said City from classification Multi -Family Dwelling District (MF) to General Business District (GB) on the following described property, to wit: Legal Description: Being 50' wide adjoining and adjacent to and running parallel with the G. C. & S. F. Right of Way and lying between Block 19, -2- 143 Pearland Townsite and G. C. & S. F. Right of Way, as recorded in Vol. 29, pg 41, of the deed records of Brazoria Co., TX (2411 S. Texas) Owner: Charles Terry Gray P.O. Box 597 Pearland, TX 77588 Planning and Zoning Chairperson Mary Starr read the purpose of the hearing into the record. Manager of Administrative Support Tobin Maples explained that the Comprehensive Plan recommends Village District uses for this area. He stated that the zone change request is compatible with the surrounding uses. He added that the owner is aware that variances would be needed prior to a building permit being approved. 111. PERSONS WISHING TO SPEAK FOR THE PROPOSED REQUEST Charles Terry Gray, 710 Rosefield, explained that when the old townsite was platted, it included a 50' strip along the railroad tracks. He stated that the property is currently zoned Multi -Family. He added that no one would want to use the property for multi- family purposes because it is too close to the railroad tracks. Mr. Gray explained that he has a concrete drive access from Texas Avenue to the property. He stated that he will use the building to store lawn equipment and maintenance items for the multi -family residences. Jerry Beetz, 200 Baton #404, League City, explained that he owns the property at 2423 Texas Avenue. He reiterated the fact that the property is useless for multi -family because of the proximity of the railroad tracks. He stated that the requested zoning would allow full benefit of the property. Mr. Beetz explained that he has been working with City staff to get resolution for access to his property from Sacramento. He stated that his property is land locked without the alley. He added that he is speaking for the zone change, however, he also wanted to express his concerns. Mr. Beetz submitted a plat to Mayor Tom Reid. IV. PERSONS WISHING TO SPEAK AGAINST THE PROPOSED REQUEST none V. COUNCIL/PLANNING COMMISSION/STAFF DISCUSSION Council Member Larry Marcott asked if Sacramento should go all the way up. Manager of Administrative Support Tobin Maples stated that the right of way is dedicated but there is no street there. -3- 144 A discussion ensued regarding the alleys, rights of ways and streets in the surrounding area. VI. ADJOURNMENT The meeting adjourned at 6:55 PM. Zoning Application No. 952 1. CALL TO ORDER The meeting was called to order at 6:55 PM. 11. PURPOSE OF HEARING Request of owners for an amendment to the Land Use and Urban Development Ordinance of said City from classification Suburban Development District (SD) to Single Family Dwelling District (R-1) on the following described property, to wit: Legal Description: Being part of Block 17 of the Figland Orchard Subdivision No. 1, Brazoria Co., TX, according to the map or plat thereof recorded in Vol. 3, pg 77 of the plat records of Brazoria Co., TX (2853 Wagon Trail Road) Owner: Asuncion Esparza 2853 Wagon Trail Road Pearland, TX 77584 Planning and Zoning Chairperson Mary Starr read the purpose of the hearing into the record. Manager of Administrative Support Tobin Maples explained that the Comprehensive Plan recommends low density residential for this area. He stated that this zone change request is consistent with the Comprehensive Plan. 111. PERSONS WISHING TO SPEAK FOR THE PROPOSED REQUEST Asuncion Esparza, owner, stated that he bought the property in May of this year. He explained that he wants to build a patio and eventually a garage. IV. PERSONS WISHING TO SPEAK AGAINST THE PROPOSED REQUEST none 12 V. COUNCIL/PLANNING COMMISSION/STAFF DISCUSSION Manager of Administrative Support Tobin Maples explained that the property owner is requesting zoning in order to make improvements to the property. Council Member Larry Marcott asked about spot zoning. He stated that the Elks Lodge near this area was recently rezoned to Commercial. City Attorney Darrin Coker explained that this request is in compliance with the Comprehensive Plan. VI. ADJOURNMENT The Joint Public Hearing adjourned at 7:02 PM.
