2000-10-09 CITY COUNCIL AND PLANNING AND ZONING COMMISSION JOINT PUBLIC HEARING MEETING MINUTES109 MINUTES - JOINT PUBLIC HEARING OF THE CITY COUNCIL AND THE PLANNING AND ZONING COMMISSION OF THE CITY OF PEARLAND, TEXAS, HELD OCTOBER 912000, AT 6:30 P.M., IN THE COUNCIL CHAMBERS, CITY HALL, 3519 LIBERTY DRIVE, PEARLAND, TEXAS A series of Joint Public Hearings was called to order with the following present: Mayor Tom Reid Mayor Pro -Tem Klaus Seeger Council Member Helen Beckman Council Member Larry Marcott Council Member Woody Owens Council Member Larry Wilkins P&Z Chairperson Mary Starr P&Z Commissioner Emil Beltz P&Z Commissioner Donald Glenn P&Z Commissioner Russ Selemon P&Z Commissioner Richard Tetens Manager of Administrative Support Tobin Maples Secretary Mona Ann Phipps Zoning Application No. 951 1. CALL TO ORDER The Joint Public Hearing was called to order at 6:31 PM. 11. PURPOSE OF HEARING Request of owners for an amendment to the Land Use and Urban Development Ordinance of said City from classification Suburban Development District (SD) to Commercial District (C) on the following described property, to wit: Legal Description: 2.8041 acres of land out of a 9.29 acre tract out of the South '/2 of Lot 30 of the Allison Richey Gulf Coast Home Co. Subdivision of Section 21, H. T. & B. R.R. Co. survey, A-309, Brazoria Co., TX (Old Chocolate Bayou Road) -1- 10 Owner: Danny Blumrick 826 Brunswick Sugarland, TX 77478 Agent: Bobby Thompson of Coldwell Banker United 11717 Highland Meadow Houston, TX 77089 Planning and Zoning Chairperson Mary Starr read the purpose of the hearing into the record. Manager of Administrative Support Tobin Maples explained that the Comprehensive Plan recommends residential for this area. He stated that the proposed use is not consistent with the Comprehensive Plan. He added that the land is vacant. III. PERSONS WISHING TO SPEAK FOR THE PROPOSED REQUEST none IV. PERSONS WISHING TO SPEAK AGAINST THE PROPOSED REQUEST E. R. Milstead, 2950 Old Chocolate Bayou Road, stated that he lives just North of the subject property. He explained that he objects to zoning the property Commercial unless he knows what is being proposed there. V. COUNCIL/PLANNING COMMISSION/STAFF DISCUSSION Council Member Woody Owens asked if City staff knew what type of commercial developmentwas proposed. Manager of Administrative Support Tobin Maples answered that staff does not know. Council Member Larry Marcott stated that when the last two properties in this area were considered for rezoning, one was rezoned to General Business and one to Neighborhood Services. He added that the zoning should be no more than General Business if it is near residential. VI. ADJOURNMENT The Joint Public Hearing adjourned at 6:42 PM. Zoning Application No. 940 1. PURPOSE OF HEARING III Request of owners for an amendment to the Land Use and Urban Development Ordinance of said City from classification Suburban Development District (SD) to Single Family Dwelling District (R-2) on the following described property, to wit: Legal Description: 56.91 acres of land, more or less, out of the H. T. & B. R.R. Co. survey, A-242, Brazoria Co., TX (Manvel Road @ Fite Road) Owner: G.K.F. Holdings, L.L.C. 11753 W. Bellfort, Suite 114 Stafford, TX 77477 Agent: Gary K. Ferguson Planning and Zoning Chairperson Mary Starr read the purpose of the hearing into the record. ManagerofAdministrativeSupportTobinMaplesstatedthattheComprehensive Plan recommends low density residential. He added that the proposed zone change request is in compliance with the Comprehensive Plan. 111. PERSONS WISHING TO SPEAK FOR THE PROPOSED REQUEST Gary Ferguson, owner, explained that they recently acquired the property and are currently working with staff on a master plan. He stated that they envision a one hundred seventy five to one hundred eighty lot subdivision. He added that they are working with proposed home builders. IV. PERSONS WISHING TO SPEAK AGAINST THE PROPOSED REQUEST none V. COUNCIL/PLANNING COMMISSION/STAFF DISCUSSION Council Member Larry Marcott stated that he received a telephone call from an adjoining property owner who was not notified of this proposed zone change. Manager of Administrative Support Tobin Maples explained that we are required to use the certified tax rolls for notification purposes. He added that unfortunately the tax rolls are not updated but approximately every six months. He also stated that he is eventually proposing to place signs on the subject property to help with notification. VI.
