MINUTES - JOINT PUBLIC HEARING OF THE CITY COUNCIL AND THE PLANNING AND
ZONING COMMISSION OF THE CITYOF PEARLAND, TEXAS, HELD SEPTEMBER 11, 2000,
AT 6:30 P.M., IN THE COUNCIL CHAMBERS, CITY HALL, 3519 LIBERTY DRIVE,

The meeting was called to order at 6:33 PM.
II. PURPOSE OF HEARING
Request of owners for an amendment to the Land Use and Urban Development Ordinance
of said City from classification Suburban Development District (SD) to Commercial District
(C) on the following described property, to wit:
Legal Description: Tract is A 4.9990 acre parcel, the North ''Y2 of Lot 2; Tract 11; A 5.1091
acre tract, the South ''Y2 of lot 2, Allison Richey Gulf Coast Home Co.
Subdivision, H.T.& B. R. R. Co. survey, A-243, Vol. 2, pg 23 & 24,

Planning and Zoning Chairperson Mary Starr read the purpose of the hearing into the
record. Manager of Administrative Support Tobin Maples explained that the
Comprehensive Plan recommends minor retail uses with high and medium density
residential.
PERSONS WISHING TO SPEAK FOR THE PROPOSED REQUEST
Paul Brent Durrett, 6120 Brookside Road, explained that this area is mostly Commercial
and the property is being used as such. He stated that the property was annexed into the
City as Suburban Development, however, Beltway 8, Highway 288 and McHard Road make
it the prime location for Commercial. He added that L & B Protective Coating has recently
been rezoned to Commercial.
PERSONS WISHING TO SPEAK AGAINST THE PROPOSED REQUEST
Joe McWhirter, 2322 Hawk Meadows, Vice President of Hawk Meadows Homeowners
Association, explained that this property has recently been cleared. He also added that it
has not been used for Commercial as previously stated. Mr. McWhirter stated that the
homeowners association urges the City to follow the plan for residential for this area. He
added that if Mr. Durrett's other property is an indication of how this property will look it
would not be good.

Frank Wenglar, 418 Cullen Boulevard, explained that his house is directly across the street
from the subject property. He stated that there are all sorts of tanks on the property. He
also stated that he has seen sandblasting and painting. Mr. Wenglar added that the
property is always overgrown and it looks like a small refinery.
Richard Williams, 1211 Crystal Lake East, stated that he would like to see the zoning
frozen for this area until the development of major residential in the area can be
recognized. He urged the City to hold a public meeting regarding this.
Roy Turner, 1431 Crystal Lake East, explained that there is a big oil rtg on the

follow the plan for this area.

Robert Melinder, 2911 Abbeyfield Drive, explained that he is opposed to this request
because of the way the land looks now. He stated that he is afraid of whaf the owners will
do if they are granted this zone change: He expressed concern about the health and safety
of his family.`
V. COUNCIL/PLANNING COMMISSION/STAFF DISCUSSION
A discussion ensued regarding the status of the steering committee for the Cullen
Boulevard area.
Council Member Woody Owens asked if anything was changing in the type of use of the
property. Mr. Durrett stated that the property use will not change. It will be used for
Commercial buildings. He explained that the property is currently leased. He also stated
that they have been sandblasting on this property since March, 1998. He added that
Commercial is the very minimum zoning for this property

Paul Brent Durrett, 6120 Brookside Drive, explained that this property has been heavy
industrial uses for the last four to five years. He stated that there is still a trucking company
and nitrogen company on the property. He added that these businesses were existing
before the development of Crystal Lake subdivision. He also stated that the property
immediately around him is vacant.
Carole Alford of L & B Protective Coating stated that they own the property just North of this
recently rezoned to Commercial. She added that it is unfair for people to move into the
area with Commercial properties and then vote against them.
Marie Thompson, 13025 Stone Road, reiterated the fact that it is not fair for people to move
into the area and vote against existing business properties.
IV. PERSONS WISHING TO SPEAK AGAINST THE PROPOSED REQUEST
Joe McWhirter, 2322 Hawk Meadows, of Hawk Meadows Homeowners Association,
explained that the homeowners association was incorporated into the City just as these
businesses were. However, he added, the City has since developed a plan for the area.
He urged the City to remain committed to the Comprehensive Plan. Mr. McWhirter stated
that the property is very inconsistently managed. He explained that they have three
tenants in one and half years.
Emma Vaughan, 2005 Cullen Boulevard, submitted photographs of the property. She

property. He questioned how the property can be rezoned without knowing what will be
placed there.
Richard Williams, 1211 Crystal Lake East, spoke against the zone change request. He
stated that he sees the area as large residential and park areas.
Roy Como, 1211 Teal Court North, expressed his opposition. He urged the City to follow
the Comprehensive Plan.
Robert Melinder, 2911 Abbeyfield Drive, explained that he is preparing to the build a home
on Cullen. He stated that this property use changes from month to month and looks
terrible.
Pat Pounds, Hawk Road, stated that she is not really for or against this zone change
request. She explained that she built the first residence in the area in 1952. She added
that she would like to keep this a residential area with some light Commercial and General
Business uses. She urged the City to work together with the residential and business
owners.

V. COUNCIUPLANNING COMMISSION/STAFF DISCUSSION
A lengthy discussion ensued regarding the grand fathered use and the current use of the
property.
Director of Administrative Support Tobin Maples stated that staff is preparing a list of
names to present to Council consisting of homeowners, business owners, homeowners
associations, etc. to form the steering committee to review the Cullen Boulevard area. He
explained that over the next seven to eight months this committee will work through the
Comprehensive Plan to reevaluate this area to see if changes are needed.

record. Manager of Administrative Support Tobin Maples stated that the Comprehensive
Plan recommends residential with General Business approximately seven hundred feet
North of the intersection of Fite and Wagontrail.
III. PERSONS WISHING TO SPEAK FOR THE PROPOSED REQUEST

Evangelos Golfis, 2431 Laura Lane, explained that he bought the property approximately
one month ago. He stated that the property is trashed, however, he will clean it up. He
added that he is proposing to build a marine electronics business on the property. Mr.
Golfis stated that the development will exceed City requirements. He also stated that he
will fence and completely clean up the property.
IV. PERSONS WISHING TO SPEAK AGAINST THE PROPOSED REQUEST
Mr. Aguilar, 2933 Wagontrail, stated that he lives directly in front of this property. He
expressed concern about the safety of the children with more truck traffic. He explained
that he thought the area was residential when he purchased the property six years ago.
V. COUNCILIPLANNING COMMISSIONISTAFF DISCUSSION
Council Member Larry Marcott asked if there were houses on Wagontrail. Director of
Administrative Support Tobin Maples stated that there are a few homes on this street.

IV. PERSONS WISHING TO SPEAK AGAINST THE PROPOSED REQUEST
John Motley, 7231 Thrush, Houston, explained that he owns two properties next to the
subject property. He stated that the map shows the name of the street incorrectly. He
added that the street is called Brookney and CR 404, not Soho Drive. 'He urged the City
to research County records to verify the correct street name. Mr. Motley stated that he is
not against the people building a home, however, he does not feel like they should be given
a permit to build without the City bringing the street through.
V. COUNCIL/PLANNING COMMISSION/STAFF DISCUSSION
City Attorney Darrin Coker stated that the road issue is irrelevant at this time. He added
that City Council and the Planning and Zoning Commission should only consider the zone
change request.
VI. ADJOURNMENT
