2000-05-01 CITY COUNCIL AND PLANNING AND ZONING COMMISSION JOINT PUBLIC HEARING MEETING MINUTES031 MINUTES - JOINT PUBLIC HEARING OF THE CITY COUNCIL AND THE PLANNING AND ZONING COMMISSION OF THE CITY OF PEARLAND, TEXAS, HELD MAY 1, 20009 AT 6:30 P.M., IN THE COUNCIL CHAMBERS, CITY HALL, 3519 LIBERTY DRIVE, PEARLAND, TEXAS 1. CALL TO ORDER The meeting was called to order at 6:30 PM with the following present: Mayor Tom Reid ' Mayor Pro -Tem William Berger Council Member Helen Beckman Council Member Klaus Seeger Council Member Richard Tetens P&Z Chairperson Mary Starr P&Z Commissioner Emil Beltz P&Z Commissioner Todd locco P&Z Commissioner Russ Selemon P&Z Commissioner Charles Viktorin Deputy City Manager Alan Mueller City Attorney Darrin Coker Director of Community Development & Services Gene Tumlinson P&Z Secretary Mona Ann Phipps 11. PURPOSE OF HEARING Request of staff to consider amendments to the Land Use and Urban Development Ordinance. The purpose of the hearing was read into the record by Mayor Pro -Tem William Berger. Deputy City Manager Alan Mueller explained that City staff has been working on revisions to the Land Use ordinance for several weeks. He stated that the Planning and Zoning Commission and the City Council has received copies of the proposed revisions. He gave a brief explanation of each of the proposed changes. Ill. PERSONS WISHING TO SPEAK FOR THE PROPOSED REQUEST -1- 032 Renee West of West Development, 6302 Broadway, spoke in reference to the proposed changes to the Overlay District Ordinance. She questioned whether anyone from the City had contacted Houston Lighting & Power regarding the way the City wants the street lights done. She explained that the last time she spoke with H.L.&P. regarding this issue there was still a great deal of confusion. Ms. West asked when the fencing requirements of this ordinance would go into effect, because no one has complied with these requirement as of yet. She questioned in what stage of the platting process these items would be required. She also asked how the developer is going to build masonry fences prior to the utilities being installed. In addition, she expressed concern about the City requiring three (3) phase electrical for lift stations. Ms. West stated that the City has not thought out these changes and worked them out with the utility companies. Suzanne Tullis, 3510 Robinson, explained that she serves on the Zoning Board of Adjustments and sees a lot of sign variance requests. She stated that the City had discussed possibly allowing more signage for larger companies, however, she did not see these types of changes in the proposed revisions. She requested that the City staff review the variances that have been requested over the past few years in order to make revisions to the ordinance, thereby reducing the number of variance requests. Ms. Tullis explained that convenience stores with restaurants and carwashes should have special provisions. In addition, she stated that the City is advertising growth in Pearland, therefore, we should revise our ordinances so as not to postpone development. Stella Roberts, 2918 Green Tee Drive, expressed concern that the web site did not tell what the Joint Public Hearing was about. She stated that she had no idea that the Overlay Ordinance was being changed. She also added that she has spoken to City Attorney Darrin Coker several times regarding changes to the sign ordinance. IV. PERSONS WISHING TO SPEAK AGAINST THE PROPOSED REQUEST Marvin Elam, 3422 West Circle, explained that he is concerned with allowing twenty (20) foot front yards because most sport utility vehicles (SUVs) are longer than nineteen (19) feet. He also added that a lot of people have boats. In addition, he asked for clarification of "...specifically excludes sales of personalities." under Professional Office. Mr. Elam also stated that cul-de-sac is defined but thumbnail lot is not. Joe Alvarez, 2203 Pearwood Circle, explained that he owns property in the new overlay district. He stated that he has a business in Pearland and knows what it takes. He added that he never seen a six (6) foot wide crooked sidewalks. He also added that the ordinance revisions call for twenty-five (25) percent of the front side of the building to be glass for the employee's protection, however, he does not see the benefit of this requirement. Mr. Alvarez explained that this building or no other building in Pearland complies. He stated that the worst offender is Pearland Independent School District who has a barn on Pearland Parkway. -2- 033 V. COUNCIL/PLANNINO COMMISSION/STAFF DISCUSSION Mayor Pro -Tem William Berger asked Deputy City Manager Alan Mueller to give a response to the items that the citizens had addressed. Mr. Mueller stated that he would be glad to review changes with Renee West. He explained that he and Director of Community Development and Services Gene Tumlinson have gone over changes, but they can certainly address more items. City Attorney Darrin Coker explained that the reference to the sale of "personalities" is actually the sale of "personalties" or personal property. Mr. Mueller stated that he would add a definition of thumbnail lot. He explained that in reference to the overlay district, all plans are reviewed for compliance. However, he added that all plan reviews are probably not perfect. He also stated that the school barn on Peariand Parkway was existing prior to the overlay district being created. Mr.Mueller explained that the sign ordinance revisions may need to address more signage for larger businesses such as Lowe's and Home Depot. Director of Community Development and Services Gene Tumlinson stated that Lowe's and The Home Depot received variances for signage. Council Member Helen Beckman asked if any business has decided not to build in Pearland because of variances being denied. Mr. Tumlinson answered no. A discussion ensued regarding the definition of a variance and in what instance a variance should be granted. Council Member Helen Beckman asked whether additional workshops would be help prior to any further action being taken on the ordinance revisions. Deputy City Manager Alan Mueller stated that he had not intended on another workshop. He explained that the revisions are on the agenda for the Planning and Zoning Commission's recommendation later tonight and first reading for City Council next week. Ms. Beckman stated that she would like to revise the section of the ordinance that allows four (4) off -premise directional signs for churches and educational institutions. She explained that she would like to allow two (2) instead of four (4) signs. Council Member Richard Tetens stated that he would like to have another workshop because there are still a number of things that should be addressed. Mr. Tetens explained that he does not feel that Planned Unit Developments (PUD) are helpful in industrial zones. A discussion ensued regarding who was notified of this Joint Public Hearing. Also discussed was the possibility of separating the ordinance revision that allows a twenty (20) foot front yard on cul-de-sac lots. Mayor Pro -Tem William Berger asked if sound barrier walls separating residential property from businesses could be addressed in the revisions. Mr. Mueller stated that he thought this would be addressed in the Engineering standards for development. -3- W Mayor Tom Reid stated that a workshop may need to be scheduled to discuss the procedures of the Zoning Board of Adjustments. Mr. Mueller explained that he will review the workshop schedule, however, right now there are workshops scheduled through June. VI. ADJOURNMENT The Joint Public Hearing adjourned at 7:25 PM. Manager of Administrative Support Tobin Maples, AICP, presented the location of the proposed zone change. Ill. PERSONS WISHING TO SPEAK FOR THE PROPOSED REQUEST Glen R. Jones, PO Box 636, Pearland, TX 77588, stated that he has been a resident here for 31 years, and they just sold his home in Hazeldale Estates. He stated that he would like to build a home on this property that is located on Manvel Road. IV. PERSONS WISHING TO SPEAK AGAINST THE PROPOSED REQUEST None V. COUNCIL/PLANNING COMMISSION/STAFF DISCUSSION Mayor Tom Reid stated that R-1 is the City's "keynote" to the residential community and it is the highest rated with the City Council. Councilmember Marcott asked what the "General Business" is next door, and property owner Mr. Jones answered that it is vacant. Mr. Marcott then recommended that he should be aware of what could go there in the future. VI. Long. CALL TO ORDER PURPOSE OF HEARING - A PROPOSAL TO INCREASE TOTAL TAX REVENUES FROM PROPERTIES ON THE TAX ROLL IN 2000 BY 8.3474 PERCENT. STAFF REVIEW OF PROPOSED TAX INCREASE City Manager, Glen Erwin, stated this tax rate has been discussed in previous meetings, and has been duly published to meet the Truth in Taxation rules. The increase is above the current rate of collection, but less than the 8% for the General Fund Maintenance and Operation rate. He further stated that the total tax rate is $0.695 per $100 property value, which is the same rate the City had the past year. He further reported that $0.435 of this rate goes toward supporting the General Fund, and $0.26 supports the retirement of debt which makes the total property tax rate of $0.695.
