MINUTES - JOINT PUBLIC HEARING OF THE CITY COUNCIL AND THE
PLANNING AND ZONING COMMISSION OF THE CITY OF PEARLAND, TEXAS,
HELD JUNE 26, 2000, AT 6:30 P.M., IN THE COUNCIL CHAMBERS, CITY HALL,

The meeting was called to order at 6:30 PM.
11. PURPOSE OF HEARING
Request of owners for an amendment to the Land Use and Urban Development
Ordinance of said City from classification Suburban Development District (SD) to
Commercial District Specific Use (C -S) for a Specific Use Permit for machining,
fabrication, and manufacturing plastics, rubber and metal products on the following
described property, to wit:

Planning and Zoning Chairperson Mary Starr read the purpose of the hearing into the
record. Director of Community Development Gene Tumlinson showed the location map.
He explained that the comprehensive plan shows Application No. 930 & SU No. 86 as
yellow - low density residential. He stated that the property was annexed October 27,
1997. Mr. Tumlinson explained that the property in Application No. 931 & SU No. 87 is
presently a boat storage. He added to the owner eventually wants to expand the
business that is existing next to it.
111. PERSONS WISHING TO SPEAK FOR THE PROPOSED REQUEST
Blaine Barker, 3703 Drummond, Houston, stated that the building was built in 1983. He
added that his partnerjoined him in 1986 and they acquired the adjoining property. Mr.
Barker explained that they manufacture air conditioning and heating products. He also
stated that every product that they make is labeled with "Made in Pearland, Texas". He
explained that their company was bought out by Jordan Corporation in 1999 and they
are proposing to expand the business.
Gary Bucek, 3907 Abbywood Drive, explained that he is also a Pearland resident. He
stated that they have expanded five times and currently employ forty-two people. He
showed several photos on the overhead of the property with the proposed addition and
their parent company locations. He explained that they run a very clean business and
have passed two environmental checks. Mr. Bucek stated that the company contributes
to the City, school and county taxes without contributing to overcrowding. He also
expressed concern about their property value.
Tom Ominson, Matrix Manufacturing, stated that his property has previously been
rezoned. He explained that he has been in business for approximately sixteen years.
He added that he has done business with Mr. Barker and Mr. Bucek for approximately
twelve years. Mr. Ominson stated that they are very solid businessmen who offer a
qualityproduct. He also stated that they run a very clean operation which supplies jobs,
a good tax base and tax revenue. He added that they employ local people and have an
investment in this community.
Dennis Fraunberger, 2602 Taylor Lane, explained that he is the Chairman for the
Pearland Economic Development Corporation. He stated that they work not only to bring
new businesses to Pearland but also to maintain existing businesses. He also stated
that this business has a $500,000.00 tax base and currently employ one hundred

employees. He added that they will eventually employ one hundred fifty employees.
Tom Alexander, 3208 Nottingham, stated that he has been developing property in
Pearland for approximately thirty-five years. He explained that Commercial property is
the City's livelihood. He also stated that subdivisions can co -exist with Commercial and
Industrial development. Mr. Alexander explained that the City should, encourage
businesses to build and continue the economic development of the City.
John Volkmer, 2915 Bentley Court, explained that he is the Chairman of the Board of
Pearland Hobby Chamber of Commerce. He stated that they support this zone change
request. He added that he drives by this business everyday and it is very clean.

Council Member Woody Owens asked if the addition would be used for manufacturing
the same product. Mr. Barker stated that it will be the same product.

111. PERSONS WISHING TO SPEAK FOR THE PROPOSED REQUEST
Emma Vaughan, 2005 Cullen Boulevard, explained that their property adjoins the L &
B Protective Coating property. She stated that she realizes that at least four businesses
on Cullen need to be rezoned. She also stated that she hopes that they can be rezoned
to where they would not have to suffer a financial loss. Ms. Vaughan explained that the
businesses should be able to be controlled to be compatible with residences. She urged
the City Council and Planning and Zoning members to'listen to the Cullen Boulevard
coalition and the citizens, then make an informed decision.
IV. PERSONS WISHING TO SPEAK AGAINST THE PROPOSED REQUEST
Susan Dietrich, 2225 Hawk Meadows Drive, stated that she has nothing against the
proposed palletcompany, however, she believesthatthe Cullen Boulevard area should
be master planned. She explained that this is a very nice green belt area and the City
needs to get busy and plan the area. She stated that Cullen is a major entry into the
City. She also stated that the property fronting Cullen should be zoned Commercial with
residential behind it. Ms. Dietrich added that there is no need for industrial in this area.
Joe McWhirter,14202 Hawk Meadows, Vice President of Hawk Meadows Home Owners
Association, explained that he is not speaking against the pallet company. He stated
that he is speaking against zoning without planning. He added that the City needs to
decide what the area is going to be so that people can offer property for the use that it
is intended for. He also stated that the homeowners in the area should be included in
the planning.
V. COUNCIL/PLANNING COMMISSION/STAFF DISCUSSION
Council Member Helen Beckman explained that the City could not zone this area when
it was annexed because there was no comprehensive plan. She stated that since this
time, the City Council has approved a master plan including this area. She also stated
that individual land owners always have the right to apply for a zone change. Ms.
Beckman added that some time in the future Council hopes to change the Suburban
Development zoned properties to other zones. She also added that once the property
is zoned, the City does have control overthe structures that are built and businesses that
move in.

Director of Community Development and Services Gene Tumlinson explained that any
time there is a change of occupancy, the City inspects the building for all code
requirements such as parking, facade, landscape, etc..
Susan Dietrich asked what the property is shown as on the comprehensive plan.
Director of Community Development and Services Gene Tumlinson stated that the area
is shown as low density residential except for General Business on the corner of Hughes
Ranch Road and Cullen Boulevard.
Council Member Larry Wilkins asked if this business would require Commercial zoning.
Director of Community Development and Services Gene Tumlinson stated that the Land
Use Book clearly states "no" for General Business, therefore, it would require
Commercial zoning. Council Member Wilkins expressed his concern with the pictures
of the existing site of the pallet company. He stated that the Council needs to be very
careful about spot zoning. He added that they should look very closely at what type of
business and what is best for the area.
Council Member Larry Marcott stated that he believes that this will be a mixed use area.
He also stated that a portion of this property has already been zoned R-1. He added that
the Council should address concrete walls to separate residential from business.

He explained that the other sections of this development are already zoned R-3.
III. PERSONS WISHING TO SPEAK FOR THE PROPOSED REQUEST
Ken Caffey, Amvest Properties, presented a site plan and explained thatthis community
is planned to have approximately six hundred (600) homes. He stated that this ten (10)
acres will allow forty (40) more homes to be built. He added that they are surrounded
by R-3 zoning and the front property will probably be Commercial. He also stated that
they adjoin the cemetery on the Northeast side.
Clinton Wong, Amvest Properties, explained that his company understands the objective
to provide quality growth. He stated that the cost of the homes in this development will
be one hundred fifty thousand dollars ($150,000.00) to two hundred thousand dollars
($200,000.00) plus. He added that the lift station and required detention already include
this tract of land.

V. COUNCIL/PLANNING COMMISSION/STAFF DISCUSSION
Council Member Larry Marcott expressed concern for the large development with no
traffic signals to allow people to get in and out. Clinton Wong explained that there is
another major thoroughfare planned along the drainage ditch and another entrance by
CR 93. Council Member Marcott stated that he is still concerned about public health and
welfare. He reiterated the need for traffic signals.
Deputy City Manager Alan Mueller stated that the proposed changes to the Land Use
ordinance address these issues with the Engineering Criteria Manual.
