MINUTES OF A PUBLIC HEARING OF THE CITY COUNCIL OF THE CITY OF
PEARLAND, TEXAS, HELD ON MAY 22, 2000, AT 6:30 P.M., IN THE COUNCIL
CHAMBERS, CITY HALL, 3519 LIBERTY DRIVE, PEARLAND, TEXAS.
The meeting was called to order with the following present:

Others in attendance: Police Chief J.C. Doyle; Director of Community Development and
Services Gene Tumlinson; Director of Finance Jim Causey; Project Manager Michael Ross.
PURPOSE OF HEARING - PROPOSED ANNEXATION
To consider the proposed annexation of approximately 12.58 acres near the southwest
corner of SH 288 and FM 2234.
STAFF REVIEW OF PROPOSED SERVICE PLAN
Deputy City Manager, Alan Mueller, stated this annexation consists of 12.58 acres on the
west side of SH 288 just south of McHard Road/Shadowcreek Parkway. This property was
previously part of MUD No. 5 (Southdown MUD). This property has been deannexed from
MUD No. 5 at the request of the property owners Pearland Investments. The 12.58 acres
are being annexed at the request of the owners of the property. The first Public Hearing was
held on May 8, 2000, and this is the second of two required Public Hearings. The first
reading of the ordinance is scheduled for June 12, and the second and final reading and
adoption of the ordinance is scheduled for June 26, 2000. The notices have been published
in the City's official newspaper, the Pearland Reporter as required by state law. Notices
have been mailed to the Justice Department and service providers. Mr. Mueller gave a brief
summary of the service plan for this property.

COUNCIL/STAFF DISCUSSION
Councilmember Marcott asked if there is a chance that the development of this property will
begin before the rest of Shadow Creek Ranch is developed and water and sewer services _
are needed ahead of time at this location?
Deputy City Manager, Alan Mueller, stated that he does not know what their time schedule
for this tract of property versus the other tracts in the development. Mr. Mueller further
stated that it is only the City's responsibility to provide the water supply and wastewater
treatment capacity, and it is the responsibility of the owner or developer of the property to
extend the proper lines to the property for theses services.
Mayor Reid stated if this property is to be folded into the Shadow Creek Ranch
Development then it will have to be included in the PUD (Planned Unit Development).
Councilmember Seeger asked if there is any more property in the area that is anticipated
to annexed like this?
Deputy City Manager, Alan Mueller, stated that at this point everything is either in the City
limits or in one of the existing Municipal Utility Districts. The only speculation is potentially
the property that is directly south of this, and at some time in the future it could be
deannexed from Municipal Utility District No. 5. At this time that property is owned by
another party and not Pearland Investments.
