WHEREAS, the City Gouncil recognazes that a public conv�nience and necessity
exists for #he location, construction, aperatian, �n� maint:enance of road, �rainage and
utili�y improvements on c�rtain real property described hereic�; and
WHEREAS, accord�ngly, the C�ty Council hereby acknawledges that �t is in the
public's best interest to acquire fee simple title fo certain property for the construction o#
road, �rainage and �atility improvemer�ts on said prop�rty; now, therefore,

Sectian 1. The City Council hereby finds �nd determines that a p�blic
convenie�ce and necessity exists for the construction of road, drainage arad utility
improvements on cer#ain real property located in Brazc�ria Caunty, Texas.
Section 2. The public convenienc� and necessity ree�ui�es the acquisition of rig�t-
of-way, by donation, purchase, candemnation, or c�tt�envise, of certain real �roperty located
vuithin the City and situated in Brazoria Gounty, more �articularly d�scribed in Exhibits "A"
and "�" at#ached hereto and incorporated herein for all purposes.
Section 3. The City Attarney, or his designee, an� oth�r City officials are f�e�eby
a�thorized �nd direcked, on behalf af the City to take sueh actions as ar� necessary #o
O�iDIfVA�ICE NU. 1421
acquire the property, des�ribed in Exhibits "A" ar�d "B" and any improvements therean,
either by dor�ation, purchase ar the exercise of tl�e power of eminent domain.
Section 4. The City Co�ncil hereby declares that a public emergency exists far
the acquisition of s�id proper�y as th� co�structiQn of ro�d, d�ainage and utility
imprQVem�nts bears dir�ctfy upon the health, safety, and welfare of the citizenry, theref�re
this Ordinance shall �e p�ssed finally on its fi�st and oratly reading and shall take effect
immediately upon its passage and ap�roval by the CFty Council.
