Ord. 0393 01-08-79ORDINANCE NO. 393 AN ORDINANCE OF THE CITY OF PEARLAND, TEXAS, CONTINUING THE TAX IMPOSED BY THE LOCAL SALES AND USE TAX ACT (ARTICLE 1066c, VERNON'S TEXAS CIVIL STATUTES) ON THE SALE AND DISTRIBUTION OF GAS AND ELECTRICITY FOR RESIDENTIAL USE IN SAID CITY, EFFECTIVE OCTOBER 1, 1979. WHEREAS, The Texas Legislature in 1967 authorized cities, by local option, to levy a 1% sales tax on various items sold within their corporate limits, and WHEREAS, on the 6th day of April, 1968, the residents of Pearland voted to exercise their right of local option for the levy of such sales tax in Pearland, Texas, and WHEREAS, it was stipulated in such election order that the proceeds from this tax be applied to the Street Department and Police Department, and WHEREAS, the revenues from this source were allocated to these Departments in the current budget, and WHEREAS, sales tax relief on franchised utility bills would be detrimental to the operations of the two specified Departments, now therefore BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, THAT: Section I The City Council of the City of Pearland, by majority vote of its governing body, hereby votes to continue the taxes authorized by the Local Sales and Use Tax Act (Article 1066c, Vernon's Texas Civil Statutes) on the receipts from the sale, production, distribution, lease, or rental of, and use, storage, or other consumption of gas and electricity for residential use, effective October 1, 1979, as authorized by Section 6 of House Bill No. 1, Acts 1978, 65th Legislature, Second Called Session.
