AN ORDINANCE OF THE CITY OF PEARLAND, TEXAS,
FIXING AND ORDERING THE RATES TO BE CHARGED
BY ENTEX, INC. FOR GAS AND GAS SERVICE TO
RESIDENTIAL AND SMALL COMMERCIAL CUSTOMERS
WITHIN THE CITY OF PEARLAND, TEXAS, ESTAB-
LISHING THE EFFECTIVE DATE, REPEALING ALL
ORDINANCES IN CONFLICT HEREWITH AND PROVID-
ING FOR SEVERABILITY.

WHEREAS, Entex, Inc. filed its Statement of Intent
Change Rates in the City of Pearland on March 20, 1980;
WHEREAS, after reasonable notice, the City Council
of the City of Pearland entered on a hearing to determine the
propriety of such change; and
WHEREAS, after said hearing, the City Council
the City of Pearland has determined the level of rates to be
charged or applied by Entex, Inc., NOW THEREFORE, BE IT
ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND:

of either (i) the effective date of this Ordinance or (ii)
May 1, 1980.

Section 5. THAT all O~dinances and parts of Ordin-
ances in conflict herewith are hereby repealed.
Section 6. THAT if any provision, section, subsec-
tion, sentence, clause or phrase of this Ordinance is for any
reason held unconstitutional, void or invalid (or for any rea-
son unenforceable), the validity of the remaining portions of
this Ordinance shall not be affected thereby, it being the
intent of the City in adopting this Ordinance that no portion
hereof or provision or regulation contained herein shall be-
come inoperative or fail by any reason of any unconstitution-
ality or invalidity of any other portion, provision or regula-
tion, and to this end, all provisions of this Ordinance are
declared to be severable.

Pearland, Texas, hereby certify: (1) that the above and
foregoing Ordinance of the City of Pearland was passed and
adopted on first reading at a regular meeting of the City
Council of the City of Pearland held on the 14th day of
April , 1980; (2) that written notice of the date, hour,
place and subject of said meeting was posted for at least 72
hours preceding the scheduled time of said meeting on a bul-
letin board located in a place in the City Hall which is con-
venient and readily accessible to the general public at all
times; (3) that the Mayor, Tom Reid ,
and Councilmen, Dennis Frauenberger , Charles
R. Mack , Fran Coppinqer , Carlton
McComb and Morris S. Wilson were present at
said meeting and acted as the City Co'uncil throughout; (4)
that the above and foregoing Ordinance of the City of Pear-
land was passed and adopted on second and final reading at a
regular meeting of the City Council of the City of Pearland
held on the 28th day of April , 1980; (5) that written
notice of the date, hour, place and subject of said meeting
was posted for at least 72 hours preceding the scheduled time
of said meeting on a bulletin board located in a place conve-
nient and readily accessible to the general public at all
times; (6) that the Mayor, Tom Reid ,
and Councilmen, Dennis Frauenberger , Charles
R. Mack , Fran Coppinaer , Carlton
McComb and Morris S. Wilson , were
present at said meeting and acted as the City council through-
out; (7) that said Ordinance has been approved and authenti-
cated by the Mayor and is duly attested by the City Secretary;
and that the same has been duly engrossed and enrolled in the
records of the City of Pearland, Texas.

single meter serving a single family dwelling and its related structures. Natural gab sup-
plied hereunder is for the individual use of the customer at one point of delivery and
shall not be resold or shared with others.

bills not paid by indicated date, gross rates shall apply, which rates shall be the above
net rates plus one cent (1¢) per 100 cubic feet of gas consumed not to exceed $3.00L

Service under this schedule shall be furnished in accordance with the Company's General Rules and Resulations.

APPLICATION OF SCHEDULE
This schedule is applicable to consumers using gas for purposes other than residential whose
consumption in any month is less than 150,000 cubic feet. When a customer uses in excess of
150,000 cubic feet in any month, the consumer shall be billed on the applicable large volume
rate schedule. Natural gas supplied hereunder is for the individual use of the customer at
one point of delivery and shallnot be resold or shared with others.
