A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PEARLAND,
TEXAS, AUTHORIZING THE CITY MANAGER OR HIS DESIGNEE TO
SUBMIT A PROPOSAL TO THE EPA'S BROWNFIELDS ASSESSMENT
DEMONSTRATION PILOT PROGRAM; AND AUTHORIZING THE CITY
MANAGER OR HIS DESIGNEE TO EXECUTE ALL DOCUMENTS
ASSOCIATED WITH THE PROJECT.
WHEREAS, many sites across the country once used for industrial/commercial
purposes have been abandoned or are under-used-some are contaminated, some are
merely perceived to be contaminated; and
WHEREAS, states and localities attempting to redevelop their abandoned
industrial sites have faced several obstacles, including the possibility of contamination
and associated liability for cleanup. The potential liability has encouraged businesses
to build in previously undeveloped nonurban areas--called "greenfields"--where they
feel more confident that no previous industrial use has occurred; and
WHEREAS, the EPA Brownfields Assessment Demonstration Pilot Program is
designed to bring together community groups, investors, lenders, developers, and other
affected parties to address the issue of cleaning up sites contaminated with hazardous
substances and preparing them for appropriate productive use; and
WHEREAS, the City of Pearland has identified three potential brownfield locations:
Rice Dryer, a 12 acre site containing asbestos constructed buildings used for storing
insecticides and herbicides; South State Highway 35, an approximate 5 acre site
previously used for the storage of radioactive film; and Magnolia Street, an abandoned
foundry encompassing less than one acre where carbons from quenching oils were
stored. Each of these sites has restricted the growth of the immediate area; now,
therefore,

BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS:
Section 1. That the recitals contained in the preamble of this Resolution are
hereby adopted and confirmed.
Section 2. That the City Manager or his designee is hereby authorized to submit
a proposal to the EPA's Brownfields Assessment Demonstration Pilot Program for
funding to assess, identify, characterize, and plan cleanup activities at contaminated
sites targeted for redevelopment.
Section 3. That the City Manager or his designee is further authorized to
execute all necessary documents associated with these Projects, as required under the
grant guidelines.
