AN ORDINANCE ALTERING THE PRIMA FACIE SPEED LIMITS
ESTABLISHED FOR VEHICLES UNDER THE PROVISIONS OF
ARTICLE 6701D, VERNON'S TEXAS CIVIL STATUTES, UPON
THE BASIS OF AN ENGINEERING AND TRAFFIC INVESTIGATION,
UPON CERTAIN STREETS AND HIGHWAYS, OR PARTS THEREOF,
WITHIN THE CORPORATE LIMITS OF THE CITY OF PEARLAND,
AS SET OUT IN THIS ORDINANCE; AND PROVIDING A PENALTY
OF A FINE NOT TO EXCEED $200 FOR THE VIOLATION OF THIS
ORDINANCE; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, Article 6701D, Vernon's Texas Civil Statutes,
provides that whenever the governing body of the City shall deter-
mine upon the basis of an engineering and traffic investigation that
any prima facie speed therein set forth is greater or less than is
reasonable or safe under the conditions found to exist at any inter-
section or other place or upon any part of a street or highway within
the City, taking into consideration the width and condition of the
pavement and other circumstances on such portion of said street or
highway, as well as the usual traffic thereon, said governing body
may determine and declare a reasonable and safe prima faciespeed
limit thereat or thereon by the passage of an ordinance, which shall
be effective when appropriate signs giving notice thereof are erected
at such intersection or other place or part of the street or highway,
now therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
PEARLAND, TEXAS:
Section 1. Upon the basis of an engineering and traffic
investigation heretofore made as authorized by the provisions of
Article 6701D, Vernon's Texas Civil Statutes, the following prima
facie speed limits hereafter indicated for vehicles are hereby deter-
mined and declared to be reasonable and safe; and such speed limits
are hereby fixed at the rate of speed indicated for vehicles traveling
upon the named streets and highways, or parts thereof, described as
follows:
(a) Along FM 518 (West Broadway) from the west city
limits to a point 1,125 feet east of the west
city limit, a distance of approximately 0.211
mile, 55 miles per hour;
(b) Along FM 518 (West Broadway) from a point 1,125
feet east of the west city limit to a point 580
feet west of Austin Street, a distance of approxi-
mately 0.640 mile, 45 miles per hour;
(c) Along FM 518 (West Broadway) from a point 580 feet
west of Austin Street to a point 132 feet west of
Washington, a distance of approximately 0.280 mile,
40 miles per hour;
(d) Along FM 518 (West Broadway) from a point 132 feet
west of Washington to SH 35. (Main Street) a dis-
tance of approximately 0.240 mile, 35 miles per
hour;
(e) Along FM 518 (East Broadway) from SH 35 (Main Street)
to Old Alvin Road, a distance of approximately 0.550
mile, 30 miles per hour;
(f) Along FM 518 (East Broadway) from Houston Avenue to
Old Alvin Road, a distance of approximately 0.488
mile, a school speed zone, 20 miles per hour, when
so signed;
(g) Along FM 518 (East Broadway) from Old Alvin Road to
a point 158 feet east of Sherwood Drive, a distance
of approximately 0.485 mile, 40 miles per hour;
(h) Along FM 518 from a point 158 feet east of Sherwood
Drive to the eastcity limit, a distance of approxi-
mately 3.373 miles, 50 miles per hour;
(i) Along FM 518 from a point 528 feet west of Regal
Oaks to a point 79 feet east of West Circle Drive,
a distance of approximately 0.200 mile, a school
speed zone, 35 miles per hour, when so signed.
Section 2. Any person violating any of the provisions of
this ordinance shall be deemed guilty of a misdemeanor and upon con-
viction thereof shall be fined in any sum not more than Two Hundred
Dollars ($200).
Section 3. This ordinance shall take effect and be in
force on the tenth day after its publication in the official news-
paper of the City of Pearland, Texas.
