Ord. 0443-01 08-10-87ORDINANCE NO. 443-1 AN ORDINANCE AMENDING SECTION 30-84 OF THE CODE OF ORDINANCES OF THE CITY OF PEARLAND, TEXAS, TO PROVIDE FOR A $100.00 TO $2,000.00 PENALTY FOR VIOLATION OF CHAPTER 30 OF THE CODE OF ORDINANCES; HAVING A SAVINGS CLAUSE; HAVING A REPEALER CLAUSE; PROVIDING FOR CODIFICATION, PUBLICATION AND AN EFFECTIVE DATE. TEXAS: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, Chapter 30 (Utilities), Article III (Sewers), Section 30-84 (Penalty for violations generally) of the Code of Ordinances of the City of Pearland, Texas, shall be and is hereby amended and shall hereafter read as follows: "Section 30-84. Penalty for violations generally. (a) A person who continues prohibited discharges or violates any other provisions of this Chapter shall be guilty of a misdemeanor and upon conviction is punishable by a fine of not less than One Hundred Dollars ($100.00) nor more than Two Thousand Dollars ($2,000.00) for each act of violation, and each day of violation shall be deemed to constitute a separate and distinct violation. (b) In addition to proceeding under authority of subsection (a) of this section, the City is entitled to pursue all other criminal and civil remedies to which it is entitled under authority of statutes or other ordinances against a person continuing prohibited discharge or violation of any other provisions of this article." If any section, subsection, sentence, clause, phrase, or portion of this Ordinance is for any reason held invalid or unconstitutional by any Court of competent jurisdiction, such portion shall be deemed as a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portions thereof. All Ordinances and parts of Ordinances in conflict are hereby repealed, but only to the extent of such conflict. herewith It is the intent of the City Council of the City of Pearland, Texas, that this Ordinance shall be codified in the City's official Code of Ordinances as provided hereinabove. The City Secretary shall cause this Ordinance to be published in the official newspaper of the City of Pearland, Texas, at least once within ten (10) days from and after the passage of such Ordinance. This Ordinance shall then become effective ten (10) days from and after its publication in the official City newspaper, or on September 1, 1987, whichever is later.
