R95 -55 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, AUTHORIZING THE CITY MANAGER TO ENTER INTO A DEVELOPMENT AGREEMENT WITH SUNSET LAKE JOINT VENTURE FOR OVERSIZING OF A SANITARY SEWER LIFT STATION IN THE SUNSET LAKES SECTIONS 2 & 3 ADDITIONS. WHEREAS, the City of Pearland's participation in the sanitary sewer lift station will relieve the overloaded condition at the Riverwalk lift station, NOW, THEREFORE, BE IT RESOLVED that: Section 1. Certain agreement, a facsimile of which is annexed hereto, designated Exhibit "A" hereof and incorporated herein for all purposes, by and between the City of Pearland and Sunset Lake Joint Venture for oversizing of a sanitary sewer lift station in the Sunset Lakes Sections 2 & 3 Additions, is hereby authorized and approved. Section 2. The participation of the City of Pearland shall not exceed $35,000.00, said funds to be allocated from the Enterprise (Water and Sewer) Fund. Section 3. The City Manager is hereby authorized and directed to execute for and on behalf of the City of Pearland and the City Secretary to attest the annexed agreement and counterparts thereof. F. Goza, President, Sunset Lake Joint Venture (hereinafter "Developer "). WITNESSETH WHEREAS, Developer wishes to develop property which is being platted in the City as the Sunset Lakes Section 2 & Additions (hereinafter "Additions "); and WHEREAS, City desires to have said Additions as part of the City; and WHEREAS, Developer requires that public utilities, including sanitary sewer and water, be available to the Additions; and WHEREAS, the City and Developer desire an agreement to set forth their respective responsibilities with respect to the development of these Additions. NOW THEREFORE, in consideration of the foregoing premises and other good and valuable consideration the receipt and sufficiency of which is hereby acknowledged, it is hereby agreed as follows: 1. The City shall participate in the cost of oversizing the sanitary sewer lift station to serve 475 lots, instead of the 239 lots in the Additions, and of oversizing a force main at a cost not to exceed $35,000.00, in proportion to the cost estimate (Attachment A) attached hereto and made a part hereof. 2. This agreement shall be governed by the laws of the State of Texas and may be amended or modified only by written agreement signed by both parties. 3. All improvements installed and constructed by Developer shall be in accordance with construction plans approved by the City Engineer. 4. Nothing herein is intended to supersede or waive any City ordinance or regulation pertaining to such construction. 5. Resolution No. R95- 55 is made a part of this Development Agreement. Date: September 6, 1995 The Sunset Lake Joint Venture, represented by L.F. (Bud) Goza, is in the process of developing residential lots along Sunset Meadows Drive and in the 40+ acre tract located between the Sunset Meadows and Riverwalk subdivisions. The existing Sunset Meadows lift station pumps to the Riverwalk lift station, which is overloaded in wet weather. Under the proposed Development Agreement, effluent from the Sunset Meadows lift station would be diverted to a new lift station in Sunset Lakes subdivision properly sized to handle the load, thereby relieving the Riverwalk lift station. Also, a new, larger force main would be installed to carry effluent from the new lift station and from the Riverwalk lift station, improving the pumping efficiency of the Riverwalk lift station. Funds for the oversize expense are available in the Water Sc Sewer Fund. Action: Printed on Recycled Paper
