AN ORDINANCE OF THE CITY OF PEARLAND, TEXAS, IMPLE-
MENTING POLICEMAN'S CIVIL SERVICE PURSUANT TO ARTI-
CLE 1269M, V.A.C.S. OF TEXAS; ESTABLISHING CLASSI-
FICATIONS FOR ALL POLICEMEN; ESTABLISHING THE NUM-
BER OF AUTHORIZED POSITIONS IN EACH CLASSIFICATION;
PROVIDING A SEVERABILITY CLAUSE, A REPEALING CLAUSE,
AN EFFECTIVE DATE, AND CONTAINING OTHER PROVISIONS
RELATING TO THE SUBJECT.
WHEREAS, by referendum election held on the 3rd day
of April, 1982, the citizens of Pearland, Texas, voted for
the adoption of a Policemen's Civil Service Act, pursuant to
applicable provisions of Article 1269M, V.A.C.S. of Texas; and
WHEREAS, by Resolution No. R82-16 adopted on the
5th day of April, 1982, the City Council of the City of
Pearland, Texas, affirmatively adopted Policemen's Civil Ser-
vice within the City and officially declared that such act
shall be effective within thirty (30) days after the beginning
of the next fiscal year of the City; and
WHEREAS, a Civil Service Commission has been duly
appointed by the Chief Executive Officer of the City, all in
accordance with applicable provisions of Article 1269M,
V.A.C.S. of Texas, as amended; and
WHEREAS, Section 8 of Article 1269M, V.A.C.S. of
Texas, as amended, requires that the City Council shall
prescribe by ordinance the number of positions of each
classification of policemen, along with a pay schedule for
each classification; NOW, THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND,
TEXAS:
Section 1. That the facts and recitations contained
in the preamble of this Ordinance are hereby found and declared
to be true and correct.
Section 2. That the City of Pearland, Texas, hereby
affirmatively adopts Policemen's Civil Service pursuant to
applicable provisions of Article 1269M of V.A.C.S. of Texas,
and hereby declares that all applicable provisions of said
Act are to be fully implemented upon the effective date of
this Ordinance.
Section 3. Pursuant to the requirements of Section
8, Article 1269M, V.A.C.S. of Texas, as amended, there are
hereby established the following classifications of employees
within the City of Pearland Police Department, with the
number of authorized positions in each of the foregoing
classifications, all of which shall be subject to the pro-
visions of said Policemen's Civil Service Act, to -wit:

Section 4. Any policemen in the actual service of
the City of Pearland on the effective date hereof and entitled
to civil service classification, shall enjoy the status of
civil service employees without having to take any competitive
examinations for the position occupied September 30, 1982,
provided such policemen have been in the service of the City
of Pearland for more than six (6) months (Section 24, Article
1269M, V.A.C.S. of Texas, as amended).
Section 5. Pursuant to the requirements of Section
8, Article 1269M, V.A.C.S. of Texas, as amended, there are
hereby established base gross monthly pay schedules for each
classification set forth in Section 3 above, said schedule
being set forth in Exhibit "A" attached hereto and made a part
of this section for all purposes as if typed herein verbatim.
Section 6. If any section, sentence, phrase,
clause, or any part of any section, sentence, phrase, or
clause, of this ordinance shall, for any reason, be held
invalid, such invalidity shall not affect the remaining
portions of this Ordinance, and it is hereby declared to be
the intention of this City Council to have passed each section,
sentence, phrase, or clause, or part thereof, irrespective of
the fact that any other section, sentence, phrase or clause,
or part thereof, may be declared invalid.
Section 7. All ordinances or parts of ordinances
in conflict herewith are hereby repealed to the extent of
conflict only.
Section 8. The City Council officially finds,
determines, recites and declares that a sufficient written
notice of the date, hour, place and subject of this meeting
of the City Council was posted at a place convenient to the
public at the City Hall of the City for the time required by
law preceding this meeting, as required by the Open Meetings
Law, Article 6252-17, Texas Revised Civil Statutes Annotated;
and that this meeting has been open to the public as required
by law at all times during which this ordinance and the
subject matter thereof has been discussed, considered and
formally acted upon. The City Council further ratifies,
approves and confirms such written notice and the contents
and posting thereof.
Section 9. This Ordinance shall take effect and be
in force as of November 1, 1982.
