Ord. 0450-08 08-26-91ORDINANCE NO. 450-8 AN ORDINANCE AMENDING ORDINANCE NO. 450-7 OF THE CITY OF PEARLAND, TEXAS, FOR THE PURPOSE OF ESTABLISHING AND REESTABLISHING A PAY CLASSIFICATION PLAN FOR THE CIVIL SERVICE EMPLOYEES; PROVIDING A SAVINGS CLAUSE, A SEVER - ABILITY CLAUSE, A REPEALING CLAUSE, AN EFFECTIVE DATE OF JANUARY 28, 1991, AND CONTAINING OTHER PROVISIONS RELATING THERETO. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: Section 1. Pursuant to the requirements of Section 143.041 of the Local Government Code, there is hereby established and reestablished a pay classification plan for Civil Service Employ- ees in accordance with Exhibit A which is annexed hereto, desig- nated Exhibit "A" hereof and incorporated herein for all pur- poses. SECTION 2. All rights and remedies which have accrued in the favor of the City under Ordinance 450 and its amendments thereto shall be and are preserved for the benefit of the City. SECTION 3. If any section, sentence, phrase, clause, or any part of any section, sentence, phrase, or clause, of this ordi- nance shall, for any reason, be held invalid, such invalidity shall not affect the remaining portions of this Ordinance, and it is hereby declared to be the intention of this City Council to have passed each section, sentence, phrase, or clause, or part thereof, irrespective of the facts that any other section, sen- tence, phrase or clause, or part thereof, may be declared in- valid. SECTION A. All ordinances or parts of ordinances in con- flict herewith are hereby repealed to the extent of such con- flict. SECTION 5. The City Council hereby officially finds, deter- mines, recites and declares that a sufficient written notice of the date, hour, place and subject of this meeting of the City Council was posted at a place convenient to the public at the 1 City Hall of the City for the time required by law preceding this meeting, as required by the Open Meetings Law, Article 6252-17, Texas Revised Civil Statutes Annotated; and that this meeting has been open to the public as required by law at all times during which this ordinance and the subject matter thereof has been discussed, considered and formally acted upon. The City Council further ratifies, approves and confirms such written notice and the contents and posting thereof. SECTION 6. This Ordinance shall take effect and be in force as of January 28, 1991. No mail order degree will be approved. Monthly longevity pay is received by the Classified Employees of the City of Pearland in accordance with the Local Government Code, Chapter 141.032. All overtime for any classification shall be paid in accordance with applicable State and Federal laws.
