Ord. 0450-09 02-10-92s ORDINANCE NO. 450-9 AN ORDINANCE AMENDING ORDINANCES NO. 450-7 AND 450-8 OF THE CITY OF PEARLAND, TEXAS, ESTABLISHING AND REESTABLISHING CLASSIFICATIONS AND A CLASSIFICATION PAY PLAN FOR ALL POLICE OFFICERS, ESTABLISHING THE NUMBER OF AUTHORIZED POSI- TIONS IN EACH CLASSIFICATION, PURSUANT TO SECTION 143.021 OF THE LOCAL GOVERNMENT CODE OF THE STATE OF TEXAS, PROVIDING A SEVERABILITY CLAUSE, A SAVINGS CLAUSE, A REPEALING CLAUSE, AN EFFECTIVE DATE, AND CONTAINING OTHER PROVISIONS RELATING TO THE SUBJECT THEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: SECTION 1. That Ordinances No. 450-7 and 450-8 passed by the City Council of the City of Pearland on January 28, 1991 and August 26, 1991, respectively, are hereby amended and, pursuant to the requirements of Section 143.021 of the Local Government Code of the State of Texas, there are hereby established the following classifica- tion of employees within the City of Pearland Police Department, with the number of authorized positions to each of the following classifi- cations, all of which shall be subject to the provisions of said Municipal Civil Service under the Local Government Code, to wit: No. of Authorized Positions Classification 25 Patrol Officer 4 Corporal 4 Sergeant 2 Lieutenant Total of 35 Civil Service Classified Positions SECTION 2. Pursuant to requirements of Section 143.021 of the Local Government Code of Texas, there is hereby established and reestablished a Pay Classification Plan for Civil Service employees in accordance with Exhibit "A", which is annexed hereto and incorporated herein for all purposes. SECTION 3. Severability Clause. If any section, sentence, phrase, clause, or any part of any section, sentence, phrase, or clause of this Ordinance shall, for any reason, be held invalid, such invalidity shall not affect the remaining portions of this Ordinance, and it is hereby declared to be the intention of this City Council to have passed each section, sentence, phrase, or clause, or part there- of, irrespective of the facts that any other section, sentence, phrase or clause, or part thereof, may be declared invalid. SECTION 4. Repealing Clause. All ordinances or parts of ordi- nances in conflict herewith are hereby repealed to the extent of such conflict. SECTION 5. The City Council hereby officially finds, determines, recites and declares that a sufficient written notice of the date, hour, place and subject of this meeting of the City Council was posted at a place convenient to the public at the City Hall of the City for the time required by law preceding this meeting, as required by the Open Meetings Law, Article 6252-17, Texas Revised Civil Statutes Annotated; and that this meeting has been open to the public as required by law at all times during which this Ordinance and the subject matter thereof has been discussed, considered and formally acted upon. The City Council further ratifies, approves and confirms such written notice and the contents and posting thereof. SECTION 6. Savings Clause. All rights and remedies which have accrued in favor of the City of Pearland under Ordinance 450, and its amendments, shall be and are preserved for the benefit of the City. SECTION 7. Effective Date. This Ordinance shall take effect and be in force from and after its passage on Second and Final Reading. PASSED and APPROVED on First Reading this o2-7 day of A. D., 1992. EDUCATION/INCENTIVE PAY All officers shall receive certification their probationary period: TCLEOSE BASIC CERTIFICATE TCLEOSE INTERMEDIATE CERTIFICATE TCLEOSE ADVANCED CERTIFICATE pay as follows after successful completion of $ .00/Month $25.00/Month $50.00/Month In addition, add the following to the above if the officer holds an Intermediate or Advanced Certificate and has: ASSOCIATE DEGREE BACHELORS DEGREE MASTERS DEGREE $ 50.00/Month $100.00/Month $175.00/Month All college degrees must be issued by an approved institution of higher education which is fully accredited by one of the regional accreditation agencies. No sail order degree will be approved. Monthly longevity pay is received by the Classified Employees of the City of Pearland in accordance with the Local Government Code, Chapter 141.032. All overtime for any classification shall be paid in accordance with applicable State and Federal laws.
