Ord. 0450-11 02-22-93ORDINANCE NO. 450-11 ORDINANCE FAILED ON SECOND READING ON MARCH 8, 1993 AN ORDINANCE AMENDING ORDINANCES NO. 450-7, 450-8, 450-9, AND 450-10 OF THE CITY OF PEARLAND, TEXAS, ESTABLISHING AND REESTABLISHING CLASSIFICATIONS AND A CLASSIFICATION PAY PLAN FOR ALL POLICE OFFICERS, ESTABLISHING THE NUMBER OF AUTHORIZED POSITIONS IN EACH CLASSIFICATION, PURSUANT TO SECTION 143.021 OF THE LOCAL GOVERNMENT CODE OF THE STATE OF TEXAS; PROVIDING A SEVERABILITY CLAUSE, A SAVINGS CLAUSE, A REPEALING CLAUSE, AN EFFECTIVE DATE; AND CONTAINING OTHER PROVISIONS RELATING TO THE SUBJECT THEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: SECTION 1. That Ordinances No. 450-7, 450-8, 450-9, and 450- 10, 28, 1991, 1992, passed by the City Council of the City of Pearland on January August 26, 1991, respectively, February 10, 1992, are hereby amended and, and December 14, pursuant to the requirements of Section 143.021 of the Local Government Code of the State of Texas, there are hereby established the following classification of employees within the City of Pearland Police Department, with the number of authorized positions to each of the following classifications, all of which shall be subject to the provisions of said Municipal Civil Service under the Local Government Code, to -wit: No. of Authorized Positions 27 Classification Police Officer 3 Corporal 4 Sergeant 2 Lieutenant Total of 36 Civil Service Classified Positions SECTION 2. Pursuant to requirements of Section 143.021 of the Local Government Code of Texas, there is hereby established and reestablished a Pay Classification Plan for Civil Service employees in accordance with Exhibit "A", which is annexed hereto and incorporated herein for all purposes. SECTION 1, Severabi]i.ty Clause. 7f phrase, clause, or any part of any section, sentence, phrase, or clause of this Ordinance shall, for any reason, be held invalid, such invalidity shall not affect the remaining portions of this Ordinance, and it is hereby declared to be the intention of this City Council to have passed each section, sentence, phrase, or clause, or part thereof, irrespective of the facts that any other section, sentence, phrase or clause, or part thereof, may be declared invalid. SECTION 4. Repealing Clause. all ordinances or part of ordinances in conflict herewith are hereby repealed to the extent of such conflict. SECTION 5. The City Council hereby officially finds, determines, recites and declares that a sufficient written notice of the date, hour, place and subject of this meeting of the City Council was posted at a place convenient to the public at the City Hall of the City for the time required by law preceding this meeting, as required by the Open Meetings Law, Article 6252-17, Texas Revised Civil Statutes annotated; and that this meeting has been open to the public as required by law at all times during which this Ordinance and the subject matter thereof has been discussed, considered and formally acted upon. The City Council further ratifies, approves and confirms such written notice and the contents and posting thereof. SECTION 6. Savings Clause. All rights and remedies which have accrued in favor of the City of Pearland under Ordinance 450, and its amendments, shall be and are preserved for the benefit of the City. SECTION 7. Effective Date. No mail order degree will be approved. Monthly longevity pay is received by the Classified Employees of the City of Pearland in accordance with the Local Government Code, Chapter 141.032.
