Ord. 0486 03-25-85T16=55 0653 ORDINANCE NO. 486 AN ORDINANCE OF THE CITY OF PEARLAND, TEXAS ABANDONING, VACATING AND RELINQUISHING AN ACCESS EASEMENT IN, UPON, OVER AND ACROSS A TRACT OF LAND OUT OF BLOCK 3, GREEN TEE TERRACE TOWNHOUSES, LOCATED AT 2812 COUNTRY CLUB DRIVE. WHEREAS, on or about the 18th day of February, 1985 Hortense B. Brinkley requested in writing that the City of Pearland, Texas abandon an access easement on property owned by her at 2812 Country Club Drive, said access easement being a 950 square foot tract of land out -of Block 3, Green Tee Terrace Townhouses, the same being a replat of Blocks 3, 7 and 8 of Green Tee Terrace, Sections I and II, recorded in Volume 177, Page 60 of the Map records of Harris County, Texas, said 950 square foot tract being more particularly described by metes and bounds on the attached Exhibit "A", incorporated herein by reference; and, WHEREAS,. Entex, Inc., Southwestern Bell and Houston Lighting and Power have expressed their willingness to release and abandon their rights to the public access easement hereinabove described; and, WHEREAS, The City Council deems that it is in the public interest to abandon, vacate and relinquish said easement, there being no public purpose or need for the same; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: Section 1. The City of Pearland, Texas does hereby in all things ABANDON, VACATE, RELINQUISH any and all rights heretofore held by it in the access easement described by metes and bounds in the attached Exhibit "A", incorporated herein by reference, the same being in, upon, over and across property located at 2812 Country Club Drive, Pearland, Harris County, Texas. Section 2. The Mayor of the City of Pearland, Texas is hereby authorized to execute any and all documents in order to effect and evidence the abandonment, vacation and relinquishment of the aforesaid access easement. Section 3. All ordinances and parts of ordinances in conflict herewith are repealed, but only to the extent of the conflict. Section 4. If any section, subsection, sentence, clause, phrase, or portion of this Ordinance is for any reason held invalid or unconstitutional by any Court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portions thereof. Section 5. It is the intent of the City Council of the City of Pearland, Texas that this ordinance shall not be codified in the City Code of Ordinances. Section 6.
