AN ORDINANCE CLOSING A PUBLIC HEARING ON
PROPOSED ASSESSMENTS FOR PAVING AND OTHER
STREET IMPROVEMENTS ON LIBERTY DRIVE, FROM
THE SOUTH RIGHT-OF-WAY LINE OF FM 518 SOUTH
TO SHADYBEND, AND ON SOUTH GALVESTON STREET,
FROM THE SOUTH RIGHT-OF-WAY LINE OF FM 518
SOUTH TO THE NORTH RIGHT-OF-WAY LINE OF
WALNUT STREET; HAVING A SAVINGS CLAUSE;
PROVIDING FOR THE EFFECTIVE DATE HEREOF.
WHEREAS, on March 18, 1985, the City Council of the City
of Pearland convened a Public Hearing on the proposed assessments
against abutting property owners of a portion of the cost of
improvements to Liberty Drive, from the south right-of-way line
of FM 518 south to Shadybend, and South Galveston Street, from
the south right-of-way line of FM 518 south to the north right-
of-way line of Walnut Street, the same consisting of concrete
curb and gutter improvements, storm drainage and sidewalks;
and,
WHEREAS, notice was given by the said City Council of
the City of Pearland, Texas, of such Public Hearing as required
by Vernon's Annotated Civil Statutes, Article 1105b, to the
public and all abutting property owners and interested parties;
and,
WHEREAS, at said Public Hearing all abutting property
owners and interested parties were given an opportunity to be
heard and to present evidence relating to the special benefits
to such abutting property by means of the above said street
improvements, and to address all matters relating to such proposed
assessments, pursuant to said Article 1105b; and,
WHEREAS, evidence was presented at said Public Hearing
on behalf of the City of Pearland, Texas, of such special benefits
accruing to the abutting property owners, which abutting property
owners were then given an opportunity to rebut such evidence; and,
WHEREAS, by Ordinances numbers 467 and 468 of the City
of Pearland, Texas, said street improvements had been authorized
and work done thereon, said Ordinance No. 467 pertaining to
said Liberty Drive Street improvements and said Ordinance No. 468
pertaining to said South Galveston Street improvements;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF PEARLAND, TEXAS:
Section 1.
That the Public Hearing, which was convened on
March 18, 1985 by the City Council of the City of Pearland, Texas,
on the proposed assessments against abutting property owners of
a portion of the cost of improvements to Liberty Drive, from the
south right-of-way line of FM 518, south to Shadybend, and
South Galveston Street, from the south right-of-way line of
FM 518, south to the north right-of-way line of Walnut Street,
be and the same is, in all things, hereby closed.
Section 2.
If any section, subsection, sentence, clause, phrase,
or portion of this Ordinance is for any reason held invalid or
unconstitutional by any court of competent jurisdiction, such
portion shall be deemed a separate, distinct and independent
provision and such holding shall not affect the validity of the
remaining portions thereof.
Section 3.
This being an Ordinance not requiring publication, the
same shall be in force and effect immediately upon its second and
final reading and passage thereof.
