Ord. 0496 08-26-85ORDINANCE NO. 496 AN ORDINANCE OF THE CITY OF PEARLAND, TEXAS AUTHORIZING THE JUDGE OF THE MUNICIPAL COURT TO IMPOSE CERTAIN EXPENSES FOR THE ISSUANCE AND SERVICE OF ARREST WARRANTS AND MAKING OTHER PROVISIONS RELATED THERETO. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: Section 1. The presiding judge of the Municipal Court of this City may, after conviction, assess upon the Defendant a special expense, not to exceed twenty-five dollars ($25.00) for the issuance and service of a warrant of arrest for an offense com- mitted under Section 38.11, Penal Code (Bail Jumping and Failure to Appear), or under Section 149, Uniform Act Regulating Traf- fic on Highways (Article 6701d, Vernon's Texas Civil Statutes, Violation of Written Promise to Appear). The presiding judge of the Municipal Court of the City may also assess the special expenses described in Article 17.04, Code of Criminal Pro- cedure, dealing with the requisites of a personal bond and a special expense for the issuance and service of a warrant of arrest, after due notice, not to exceed twenty-five dollars ($25.00). Section 2. All costs collected pursuant to Section 1 shall be paid into the City Treasury for the use and benefit of the City. Section 3. It is the intent of the City Council of the City of Pearland, Texas that this Ordinance shall not be codified in the City Code of Ordinances. Section 4. All Ordinances and parts of Ordinances in con- flict herewith are hereby repealed, but only to the extent of such conflict. Section 5. If any section, subsection, sentence, clause, phrase, or portion of this Ordinance is for any reason held invalid or unconstitutional by any court of competent juris- diction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portions thereof. Section 6. The City Secretary shall cause the caption and Section 1 of this Ordinance to be published in the official newspaper of the City at least once after its passage on second and final reading. This Ordinance shall thereafter become ef- fective immediately upon the date of such publication.
