Ord. 0505 11-25-85ORDINANCE NO. 505 AN ORDINANCE ESTABLISHING SPEED LIMITS DURING CONSTRUCTION ON A PORTION OF FM 518 WITHIN THE CITY OF PEARLAND, TEXAS; PROVIDING FOR SIGNS; PROVIDING A PENALTY FOR VIOLATION; HAVING A SAVINGS CLAUSE; HAVING A REPEALER CLAUSE; PROVIDING FOR PUBLICATION; PROVIDING FOR AN EFFECTIVE DATE AND CANCELLATION THEREOF. WHEREAS, the State Department of Highways and Public Transportation has made it known to the City of Pearland that operations will begin in the near future to repair the existing roadway pavement with concrete pavement and installed pavement marking and signing along FM 518; and, WHEREAS, in the interest of safety, it is desirable to maintain a construction speed zone during the construction period; now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS; that, Section 1. A construction speed zone is hereby established along the named highways or parts thereof described as follows: Along FM 518 from a point 960 feet northwest of Winding Road to Pearland southeast city limit, a distance of approximately 0.240 mile, 35 MPH to be effective when so signed within said zone. Section 2. Necessary signs for posting the speed zones will be fur- nished, installed, and maintained by the direction of the State Department of Highways and Public Transportation engineer in charge of the project. Section 3. Any person violating the provisions of this Ordinance shall, upon conviction, be fined in any sum not to exceed Two Hundred Dollars ($200.00). Section 4. If any section, subsection, clause, phrase, or portion of this Ordinance is for any reason held invalid or unconstitu- tional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portions thereof. Section 5. All Ordinances with are hereby and parts of Ordinances in conflict here - repealed, but only to the extent of such conflict. Section 6. It is the intent of the City Council of the City of Pearland, Texas City's official Section that this Ordinance shall not be codified in the Code of Ordinances. 7. The City Secretary shall cause this Ordinance, or the caption and penalty hereof, to be published in the official news- paper of the City of Pearland, Texas at least once within ten (10) days after the passage Section 8. This Ordinance of such Ordinance. shall be in effect immediately after publica- tion, but only during the period of construction, and completion of this project shall automatically cancel the speed zones.
