AN ORDINANCE ESTABLISHING A TEMPORARY 90 DAY MORATORIUM
ON ISSUANCE OF PERMITS FOR BILLBOARDS AND OTHER OFF
PREMISE SIGNS; DECLARING AN EMERGENCY PURSUANT TO SEC-
TION 3.10 OF THE CHARTER OF THE. CITY OF PEARLAND, TEXAS
AND. PROVIDING AN EFFECTIVE DATE.
WHEREAS, there is a rapidly increasing incidence of billboards
and off -premise signs in the City of Pearland and the City Council
perceives the urgent need to study and re-evaluate the City
ordinances, rules and regulations pertaining thereto; and,
WHEREAS, the City Council finds and is of the opinion that the
status quo should be maintained for a temporary and reasonable period
of time with respect to the issuance of permits for the erection of
billboards and off -premise signs so that such study and re-evaluation
may be done in a quick and effective manner and the results thereof
not be frustrated; NOW, THEREFORE,
TEXAS:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND,
SECTION 1. That the Building Official shall issue no permits
for billboards or off -premise signs until April 14, 1986. Application
prior to the effective date hereof shall not constitute exemption
herefrom.
SECTION 2. That no person, firm or corporation shall erect,
cause to be erected or permit the erection of any billboard or off -
premise sign within the territorial limits of the City prior to April
14, 1986.
SECTION 3. That the necessity to maintain the status quo for a
reasonable period of time with respect to the issuance of permits for
billboards and off -premise signs so that there may be a study and re-
evaluation of the City ordinances in relation thereto creates an
emergency calling for immediate action of the City Council for the
preservation of the public peace, health, safety and welfare;
therefore, an emergency is hereby declared to exist. The rule
requiring the reading of ordinances on two separate occasions is
hereby suspended and this ordinance shall become effective immediately
upon its passage on its first and only reading as provided by the
Charter of the City of Pearland.
