Ord. 0507 02-10-86NOTICE OF SPECIAL ELECTION THE STATE OF TEXAS 0 CITY OF PEARLAND *t TO THE RESIDENT QUALIFIED VOTERS OF THE CITY OF PEARLAND, TEXAS: TAKE NOTICE that an election will be held on the 5th day of April, 1986, in the City of Pearland, Texas, at the place, in the manner, and for the proposed Charter amendments set forth in the attached copy of Ordinance No. 507, duly passed by. the City Council of the City of Pearland on the loth day of February, 1986. Said attached Ordinance is made a part of this Notice for all intents and purposes. Kay Kuse City Secretary City of Pearland, Texas ORDINANCE NO. 507 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, ORDERING A SPECIAL ELEC- TION TO BE HELD ON THE 5TH DAY OF APRIL, 1986; DESIGNATING THE HOURS AND PLACE FOR HOLDING SUCH ELECTION AND PROVIDING FOR SUBMISSION TO THE VOTERS OF CERTAIN PROPOSED CHARTER AMEND- MENTS. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEAR - LAND, TEXAS: That the following proposed amendments to the Home Rule Charter of the City of Pearland, Texas, shall be submitted to the vote of the duly qualified electors of the City of Pearland, Texas, at the same time and places of the Regular City Election to be held on April 5, 1986, pursuant to applicable provisions of the Home Rule Charter and applicable statutes of the State of Texas, and that the following portions of the Charter of the City of Pearland are proposed to be amended to read as follows: For or Against the following proposed amendments: Proposed Amendment No. 1 Add subsection (d) to Section 4.01 -- City Manager -- to read as follows: "(d) Assistant City Manager: The City Manager, with the approval of the City Council, may appoint an Assistant City Manager who shall be the administrator of all Departments which are directly answerable to the City Manager, with the exception of those Departments administered by the Director of Public Works. Such Assistant City Manager shall have all of the powers and duties of the City Manager in the event of the absence or disability of the City Manager." Proposed Amendment No. 2 Omit sentence seven (7) from paragraph (1) of Section 4.09 -- Volunteer Fire Department -- which presently reads as follows: "The City Council may pass, with approval of the Fire Depart- ment, such ordinances as they may deem proper for the wel- fare of said Department." Proposed Amendment No. 3 Omit the last sentence from paragraph two (2) of Section 4.09 -- Volunteer Fire Department -- which presently reads as follows: "The City Council shall also cooperate with the neighboring communities of Brazoria County on problems of fire preven- tion." Proposed Amendment No. 4 Amend Section 4.11 -- Department of Public Safety -- in its entirety, to read as follows: "The City Council may appoint a Safety Department which shall be an advisory coordinating committee in the matter of Public Safety. Such committee will then consist of an odd number of members, who shall be either employees of, or shall reside in the City of Pearland." The above proposed Charter amendments shall be submitted to the qualified electors of The City of Pearland at the time and in the manner required by law and in accordance with the procedure otherwise employed in connection with the election of City offi- cers. The Presiding Judge shall appoint two additional Clerks to assist in the voting on the above proposed Charter amendments. The City Secretary is hereby directed to cause notice of the submission of said Charter amendments to be published in the official city newspaper on two successive weeks, with the - 2 date of the first publication to be not less than fourteen (14) days prior to the date of the election, together with the complete text of each proposed amendment. That immediately after said election is held, the officers holding same shall make returns of the results thereof to the Mayor of this City as required by the Election Code. A copy of this Ordinance shall also serve as a writ of election which shall be delivered to the duly appointed Presiding Judge for said elec- tion.
