AN ORDINANCE CREATING A POLICE RESERVE FORCE IN AND FOR THE
CITY OF PEARLAND, TEXAS, PROVIDING FOR APPOINTMENTS, QUALIFICATIONS,
OATH, IDENTIFICATION, POWERS, DUTIES AND COMPENSATION; PROVIDING
A SAVINGS CLAUSE; PROVIDING A'REPEALING CLAUSE AND AN EFFECTIVE
DATE HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS:
Section -I.. Creation Appointments - Qualifications.
There is hereby created a Police Reserve Unit in and for the City of Pearland
to be known as the Pearland Police Reserve. The membership of such reserve
shall consist of not more than twelve (12) members, and shall be made up of persons,
who at the time of their appointment shall be residents of the City of Pearland.
Each member shall be in good physical condition, of good moral character, not
less than twenty-one (21) years of age and shall not be indebted to the City.
Appointments to the Police Reserve shall be made by the Chief of Police, by
and with the advice and approval of the City Council, provided however, that any
member may be discharged at any time upon recommendation of the Chief of Police
and with the advice and consent of the City Council,. No person: appointed to tT
Police Reserve Force may carry a weapon or otherwise act as a peace officer until
he has been approved by the City Council, and after approval, he may carry a
weapon only when authorized by the Chief of Police and when discharging official
duties as a duly constituted peace officer.
Section II. Duties - Powers - Identification - Oath.
The Police Reserve Force shall function under the immediate direction of the
Chief of Police or in his absence, the senior officer on duty. Members of the
Police Reserve Force shall serve at the discretion of the Chief of Police and
may be called into service at any time the Chief of Police considers it necessary
to have additional officers to preserve the peace and enforce the law.
Before entering upon his duties each reserve officer shall take and subscribe
to the same oath or affirmation as provided by the Statutes of Texas to be taken
and subscribed by all Municipal Officers. After subscribing to the oath of office
each member of the reserve shall be issued an Identification Card which

will be signed by the Mayor and Chief of Police.
Said Identification Card shall be retained in the personal possession of the
member at all times. Members of the Police Reserve, while on active duty, shall
have all the powers and authority and shall be subject to all the duties of members
of the regularly constituted Police Department and shall be subject to the rules,
regulations and assignments governing the Police Department, provided, however,
that membership in the Police Reserve shall not constitute membership in the
regularly constituted Police Department nor shall any member of the reserve be
entitled to any right or privilege of compensation, pensions, vacation or any
other similar right or privilege of members of the regularly constituted Police
Department, nor to any other prerequisite or involvement attaching to membership
in said regularly constituted Police Department.
Section III: Training and Educational Standards.
The Chief of Police shall determine the program for training members of the
Reserve Force in police work. Such training program to be in accord and consistent
with the minimum training standards established, or to be established, by the Texas
Commission on Law Enforcement Officer Standards and Education. Tuition or fees
for said training programs, courses or seminars shall be paid for by individual
reserve officers without reimbursement from the City.
Section IV. Compensation.
No member of the Police Reserve Force shall receive any compensation from
the City for his services as a member of the Police Reserve Force excepting as
may be provided from time to time by Resolution of the Mayor and City Council.
Section V: Uniforms - Pistols.
Police Reserve Members shall wear such uniforms and other necessary equipment
as the Chief of Police may prescribe and direct. Such uniforms and equipment shall
be furnished by the City, with the exception of service pistols. All service
pistols shall be paid for by Police Reserve members without reimbursement from the
City.
Section VI: Savings Clause.

If any section, paragraph, clause, or sentence shall be declared void and
unenforceable or unconstitutional, it is hereby declared the intention of the City
Council of the City of Pearland that the remainder of such ordinance shall remain
in full force and effect.
Section ViI. Repealing Clause.
All ordinances in force when this ordinance becomes effective and which
ordinances are inconsistent herewith or in conflict with this ordinance are hereby
repealed, insofar as said ordinances are inconsistent or in conflict with this
ordinance. Ordinance No. 217-1 is hereby expressly repealed.
Section VIII. Effective Date.
This ordinance shall be effective and be in full force and effect after its
passage and approval upon second and final reading.
