Ord. 0224-02 03-13-78ORDINANCE NO. 224-2 AN ORDINANCE OF THE CITY OF PEARLAND, TEXAS, AMENDING CERTAIN PROVISIONS OF THE STANDARD BUILDING CODE, 1976 EDI- TION, HERETOFORE ADOPTED AND CODIFIED AS THE BUILDING CODE OF THE CITY OF PEARLAND, TEXAS; PROVIDING AN EFFECTIVE DATE, A SEVERABILITY CLAUSE, AND CON- TAINING OTHER PROVISIONS RELATING TO THE SUBJECT. IBE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: 1 SECTION I. That Chapter IV, Section 403, Subsection 403.2 entitled Ten- ant Separation, of the Standard Building Code, 1976 Edition, be and the same is hereby expressly amended to read as follows: "403.2-Tenant Separation In a building, or portion of a building of a single occupan- cy classification, when enclosed spaces are provided for separate tenants, such spaces shall be separated by not less than two (2) hour fire resistance." SECTION II. That Chapter IV, Section 411, Subsection 411.3-3, entitled Special Protective References, of the Standard Building Code, 1976 Edition, be and the same is hereby expressly amended to read as, follows: "3. All dwelling units or apartments within multiple dwell- ings shall be separated with two (2) hour fire resistive construc- tion. (See Section 403.2) SECTION III. That Chapter XII, Section 702, Subsection 702.3 entitled Partition Requirements by Occupancy -Group R-Residential, of the Standard Building Code, 1976 Edition, be and the same is hereby expressly amended to read as follows: "Group R-Residential-Except in one and two family dwellings, all partitions along public hallways or partitions that separate apartments, or that separate apartments from other occupancies, shall be of not less than two (2) hour fire-resistant construction. Non -fire rated partitions may be permitted within individual dwell- ing units." SECTION IV. For the purpose of this Code the Fire District shall be that area or territory set forth in Section 7-1 of Chapter 7 of the Code of Ordinances of the City of Pearland, Texas. SECTION V. It is hereby ordained that this ordinance, when approved and adopted, shall be made a part of, and incorporated into, the Code of Ordinances of the City of Pearland, Texas, and said Code is hereby expressly amended to include such additions and amendments as specified in this ordinance. SECTION VI. If for any reason any section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a Court of competent juris diction, it shall not affect any other section, paragraph, subdi` vision, clause, phrase, word, or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. SECTION VII. All existing ordinances, parts of ordinances, or Code pro- visions or parts of Code provisions, in conflict herewith are here- by repealed only to the extent of such conflict. SECTION VIII. This ordinance shall be effective and be in full force and effect ten (10) days from and after its adoption on second and final reading. The City Secretary is hereby authorized and direc- ted to publish the caption of this ordinance in the official news- paper of the city -in accordance with the provisions of the Charter of the City of Pearland, Texas.
