AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PEAR -
LAND, TEXAS, AMENDING THE CODE OF ORDINANCES AT SECTION
7-13.1 ADOPTING SECTION 403.4.1 OF THE STANDARD BUILD-
ING CODE FOR THE PURPOSE OF PROVIDING AN EXCEPTION TO
REQUIREMENTS FOR 2-HOUR FIRE RESISTANT TENANT SEPARA-
TION IN CERTAIN SPECIFIED BUILDING GROUPS; PROVIDING A
PENALTY FOR VIOLATION THEREOF; CONTAINING A SAVINGS
CLAUSE, AND A SEVERABILITY CLAUSE; PROVIDING FOR CODI-
FICATION, PUBLICATION, AND AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND,
TEXAS:
Section 1. That Section 7-13.1 of the Code of Ordinances
of the City of Pearland is hereby amended insofar as it adopts
Section 403.4.1 of the Standard Building Code such that Section
403.4.1 shall hereafter read as follows:
403.4.1 Tenant Separation
In a building or portion of a building of a single occupancy
classification, when enclosed spaces are provided for sepa-
rate tenants, such spaces shall be separated by not less
than 2-hour fire resistance.
EXCEPTION: In Group S buildings, non -fire rated partitions
may be used to separate tenants provided no area between
partitions rated at 2-hour or more exceeds 3000 sq. ft.
Section 2. Any person, firm or corporation who shall vio-
late or fail to comply with the requirements and provisions of
the Code herein adopted shall be deemed guilty of a misdemeanor,
and shall, upon conviction by a court of competent jurisdiction,
be punished as provided in Section 1-11 of the City Code of
Ordinances.
Section 3. All rights and remedies which have accrued in
the favor of the City under this Chapter and amendments thereto
shall be and are preserved for the benefit of the City.
Section 4. If any section, subsection, sentence, clause,
phrase or portion of this Ordinance is for any reason held in-
valid or unconstitutional or otherwise unenforceable by a court
of competent jurisdiction, such portion shall be deemed a sepa-
rate, distinct and independent provision and such holding shall
not affect the validity of the remaining portions thereof.
Section 5. It is the intent of the City Council of the City
of Pearland, Texas, that this Ordinance shall be codified in the
City's official Code of Ordinances as provided hereinabove.
Section 6. The City Secretary shall cause this Ordinance,
or its caption and penalty, to be published in the official
newspaper of the City of Pearland at least once within ten (10)
days after the passage of such Ordinance. The Ordinance shall
then become effective ten (10) days from and after its publica-
tion, or the publication of its caption and penalty, in the
official City newspaper. ��JJ//
