WHEFtEAS, the City Co�r�cil recognizes that a public convenience and necessity
exists for t�e locafion, construction, operatian, and maintenance of road, drainage and
utility �mprovements an certain real property described herein; and
WHEREAS, accordingly, t�e Gity Cauncil hereby acknowledges that it is in #he
pU�IiC best interest ta acquire �ee si�'npBe title to certain property for the eonstruction of
road, drainage and utility improvements on said ;�ra�erty; now, therefore,
BE IT ORDAINED �Y THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS:
Sec#ion 1. The Gity Couracil hereby finds and deterrr�ines that a public
conuenienc� and r�ecessity exists for the construction Qf road, dra�inage and u#ility
improvernents or� certain real property located in Brazoria County, Texas.
Se�tior� 2. The public convenaence and necessity requires the acquisitian of right-
of-way, by donation, purchase, condem�nation, or otherwise, of certain real pro�erty loc�t�d
within t�e City and situated in Brazoria Co�nty, more particularly described in Exhibits "A'"
and "B'" attached hereto and incorporate� herein for all purposes.
Sec#ion 3. The City Attorney, o� his d�signee, and c�th�er City officials �re hereby
authorized and directed, on behalf of the Gity to take such actions as are necessary to

�cquire the property, descri�ed in ExhQbits "A" and "B" and any improvements thereor�,
eithe� by donation, purchase or the �xercise n� the power of err�inent domain.
Section 4. The City Council hereby declares that a�ublic emergency exi�ts far
the acquisition of said pro�erty as the constructiQn of �oad, drainage and utility
im�rovements bears directly up�n the health, safety, and welfare o�the citizenry; therefore
this Ordinance shall be passed finally on its f6rst and only reading �nd shall take effect
immed�ately u�on its passage and approval by the City Council.
