A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PEARLAND,
TEXAS, APPROVING WORK AUTHORIZATION #5 FOR DRAINAGE
STUDY, SURVEYING AND RIGHT-OF-WAY DOCUMENT PREPARATION
SERVICES ASSOCIATED WITH THE PEARLAND MOBILITY AND
DRAINAGE BOND PROGRAM.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS:
Section 1. That certain contract by and between the City of Pearland and Turner,
Collie and Braden, Inc., ("T C & B) for Program Management of the Pearland Mobility and
Drainage Bond Program was authorized by the City Council on December 10, 2001.
Section 2. That T C & B has developed work authorization #5, which is attached
hereto as Exhibit "A".
Section 3. That the work authorization for drainage studies, surveying and Right-
of-Way document preparation services associated with the Cullen Road Extension Project
is hereby approved.

This Work Authorization is made pursuant to the terms and conditions of the Pearland
Mobility & Drainage Bond Program, hereinafter identified as the "Contract", entered into
by and between the City of Pearland ("City"), and Turner Collie & Braden Inc.
("Engineer).
PART 1. Work Authorization No. 5 is related to The Cullen Road Extension Project.
The Engineer will perform Hydrology and Hydraulic Analysis.
PART 2. The maximum amount payable for services under this Work Authorization is
$76,326. This amount is based on the attached fee proposals submitted by Walsh/Freese
& Nichols, Inc., in the amount of $29,126 for Drainage Studies, and by The Wilson
Survey Group, Inc., in the amount of $35,200.00 Topographic Survey and $12,000.00 for
ROW Acquisition Documents.
PART 3. Payment to the Engineer for the services established under this Work
Authorization shall be "Lump Sum".
PART 4. This Work Authorization shall become effective on February 11, 2002 and
shall terminate on November 12, 2005, unless extended by a supplemental work
authorization.
PART 5. This Work Authorization does not waive the parties' responsibilities and
obligations provided under the contract.
PART 6. This Work Authorization is hereby accepted and acknowledged below.

AGREEMENT FOR PROFESSIONAL SERVICES
STATE OF TEXAS
COUNTY OF HARRIS
This AGREEMENT is entered into by the Turner Collie & Braden, Inc., Houston, Texas, hereinafter called
"OWNER" and Walsh/Freese & Nichols, Inc., hereinafter called "WFN". In consideration of the AGREEMENTS
herein, the parties agree as follows:
EMPLOYMENT OF WFN: In accordance with the terms of this AGREEMENT: OWNER agrees to
employee WFN; WFN agrees to perform professional services in connection with the Project; OWNER
agrees to pay to WFN compensation. The Project is described as follows: Hydrologic and Hydraulic Study
for the Cullen Blvd. Extension between F. M. 518 and Northfork Drive.
II.
SCOPE OF SERVICES: WFN shall render professional services in connection with Project as set forth
in Attachment SC - Scope of Services and Responsibilities of OWNER which is attached to and made a
part of this AGREEMENT.
III.
COMPENSATION: OWNER agrees to pay WFN for all professional services rendered under this
AGREEMENT in accordance with Attachment CO - Compensation which is attached hereto and made a
part of this AGREEMENT. WFN shall perform professional services as outlined in the "Scope of
Services" based on a Lump Sum fee of $29,126. Detail concerning the fee is included in Attachment CO.
TERMS AND CONDITIONS OF AGREEMENT: The Terms and Conditions of Agreement as set forth
as Attachment TC shall govern the relationship between the OWNER and WFN.
Nothing under the AGREEMENT shall be construed to give any rights or benefits in this AGREEMENT to anyone
other than OWNER and WFN, and all duties and responsibilities undertaken pursuant to the AGREEMENT will be
for the sole and exclusive benefit of OWNER and WFN and not for the benefit of any other party.
This AGREEMENT constitutes the entire AGREEMENT between OWNER AND WFN and supersedes all prior
written or oral understandings.
This contract is executed in two counterparts.

SCOPE OF SERVICES AND RESPONSIBILITIES OF OWNER
ARTICLE I
BASIC SERVICES: Prepare a comprehensive drainage study of the Project. The drainage study
will be prepared based on the existing Tranquility Lake Development Detention Facility receiving
the post-development flow. The drainage study report will be conducted in two parts:
A. EXISTING CONDITIONS ANALYSIS
1. Schedule and attend up to three meetings with City of Pearland/Program Manager for
drainage coordination.
2. Identify existing drainage outfalls along the Project. A site reconnaissance will be
performed to verify drainage patterns, and existing cross drainage structures within project
site and along proposed outfall route on Fite Road to the Tranquility Lake Development
Detention Facility (intended point of outfall). If supplemental topographic survey is
required, the OWNER shall be notified to obtain pertinent physical features along the
drainage outfalls. All field surveying for the purpose of Project shall be provided by the
OWNER. (See Article IIID)
3. If necessary, obtain available hydrologic and hydraulic data and computer models (HEC-1
and HEC-2) from applicable drainage authorities, to the extent possible, for use in analysis
and determination of existing 5-, 25- and 100-year water surface elevation of bayous,
creeks and ditches along the project.
4. Prepare a watershed map and identify existing drainage boundaries. Drainage boundaries
will be obtained using available contour maps and through limited field reconnaissance.
5. Compute peak flows for the existing drainage and proposed systems in accordance with
Brazoria Drainage District No. 4 and City of Pearland criteria and methodology.
6. Determine the hydraulic capacity of the existing drainage structures and outfalls along the
Project route. The 5-, 25- and 100-year water surface elevations will be computed at the
drainage outfalls along Fite Road. Scope does not include hydrologic/hydraulic analysis
of the Tranquility Lake Development Detention Facility.
7. Determine the profile of the natural ground along each proposed right-of-way, and the
existing roadway profile. This data will be utilized in the development of design roadway
profiles.
8. Superimpose these profiles on a drawing along with the 5-, 25- and 100-year water surface
elevations. The profile drawing will provide an overall view of the roadway/existing
ground elevations with respect to the various storm design frequencies for the length of
the Project. This will enable the OWNER to determine the most feasible proposed
roadway profile.
9. Summarize the above items in an interim progress submittal. Drainage areas and sheet
flow will be presented graphically in an exhibit. The plans and profiles will also be
included. Two copies will be submitted for review.
10. Coordinate with all applicable government agencies including Brazoria Drainage District
No. 4 and City of Pearland. This does not include Corps of Engineers Section 404
Permitting.
B. PRELIMINARY IMPACT ANALYSIS
1. Determine a hydraulic gradeline starting at the Tranquility Lake Detention Facility for
each storm sewer system in order to obtain a design tailwater for each existing system.

The design tailwater will be the starting basis for the design of the proposed storm sewer
system.
2. Limit the outfalls for drainage areas into existing storm sewer to existing capacity flows,
which will be determined. Alternate flow routes, if feasible, will be looked into for
relieving storm sewer overload. The amount of the total detention storage to control storm
sewer runoff for the design frequency will be determined.
3. Determine drainage areas and flows for cross drainage systems as part of the preliminary
impact analysis. Sizing of the drainage crossings and hydrologic information, once
determined, will be provided to the OWNER.
4. Calculate the cut and fill impact quantities. Determine any impact on the right-of-way
requirements due to the above analysis.
5. Prepare a preliminary impact analysis, which shall include the preliminary findings of the
proposed cross drainage structures, storm sewer capacities, requirement for line rerouting,
preliminary detention storage volume and initial recommendations on how to mitigate the
storm impact on the receiving streams. The storm sewer, conceptual and generic
discussions of alternatives considered, a comparative cost associated with each alternative,
and recommended solution.
6. Provide eight (8) copies of the drainage study report to Brazoria Drainage District No. 4
and City of Pearland for review and comment. Recommendations at this point should be
generic and conceptual in nature, mainly for discussions with Brazoria Drainage District
No. 4 and City of Pearland.
C. FINAL IMPACT ANALYSIS
The final impact analysis will be performed on bayous, creeks, and ditches as related to the City of
Peafland and FEMA criteria 5-, 25- and 100-year storm. The impact prediction is presented as
follows:
1. Finalized drainage areas for the existing and proposed conditions along the Project route.
2. Finalize the hydraulic conveyance capacities of the existing drainage outfalls.
3. Obtain current hydrologic and hydraulic computer models from government agencies and
review and comment on the models. Current models will be updated to existing
conditions and submitted to Brazoria Drainage District No. 4 and City of Pearland as the
revised existing condition model.
4. Analyze existing and proposed drainage system and quantify the increase in 100-year peak
flows resulting from the roadway improvements. Compute existing and proposed peak
flows by using hydraulics and hydrologic methodology and computer models. The
additional lines should be accounted for the increasing percent development.
5. Analyze proposed roadway and Fite Road drainage improvements to quantify impacts to
revised existing conditions model.
6. Base storage computations on hydrograph calculations and peak flows obtained in Item B
above. A mitigation volume for the 100-year storm will be computed.
7. Compute right-of-way corridor 100-year floodplain volumes for existing and proposed
roadway elevations. No decrease in 100-year floodplain volumes will be allowed without
adequate off-site mitigation. Hand calculations shall be provided which quantify the cut
and fill within the 100-year floodplain, if any occur. Identify the additional right-of-way
to satisfy floodplain and/or detention requirements.
8. Prepare conceptual 100-year sheet flow analysis for the project utilizing existing and
proposed conditions. Determine impacts of the proposed vertical alignment on sheet flow.
9. Provide eight copies of a separate drainage report (signed and sealed by a Licensed
Professional Engineer) to City of Pearland and Brazoria Drainage District No. 4.

ARTICLE II
TIME OF COMPLETION: WFN is authorized to commence work on the Project upon
execution of this AGREEMENT and agrees to complete the services called for in Article I A, B, C
so as to deliver the completed final drainage study report to the OWNER within 90 days after
receipt of all field survey information. Review periods by City, Brazoria Drainage District No. 4,
and acquiring approvals and permits have not been accounted for.
IfWFN's services are delayed or suspended in whole or in part by OWNER, or ifWFN's services
are extended by the Contractor's actions or inactions for more than 90 days through no fault of
WFN, WFN shall be entitled to equitable adjustment of rates and amounts of compensation.
ARTICLE III
RESPONSIBILITIES OF OWNER: OWNER shall perform the following in a timely manner
so as not to delay the services of WFN:

Designate a person to act as OWNER's representative with respect to the services to be
rendered under this AGREEMENT. Such person shall have contract authority to transmit
instructions, receive information, interpret and define OWNER's policies and decisions
with respect to WFN's services for the Project.
Provide all criteria and full information as to OWNER's requirements for the Project,
including design objectives and constraints, space, capacity and performance
requirements.
Assist WFN by placing at WFN's disposal all available information pertinent to the
Project including previous repons and any other data relative to the Project.
Provide complete topographical information including 100-ft cross-sections along
Fire Road and along the proposed preliminary roadway alignment. Above information
shall be provided in AUTOCAD Release 2000 electronic format with a hard copy.
Provide existing drainage/hydraulic study performed on Tranquility Lake Development
Detention Facility for review purpose only. Scope of this project does not include
hydrologic/hydraulic analysis of this Detention Facility.
Provide proposed roadway alignment to be used for the Project. New roadway alignments
after completion of hydrologic and hydraulic analysis shall be considered additional
services.
Arrange for access to and make all provisions for WFN to enter upon public and private
property as required for WFN to perform services under this AGREEMENT.

COMPENSATION
Lump Sum: Compensation to WFN for the services defined in Attachment SC for the
Hydorologic and Hydraulic Study for the Cullen Boulevard Extension between FM 518
and Northfork Drive shall be a lump sum of $29,126. IfWFN sees the Scope of Services
changing so that additional services are needed, WFN will notify OWNER for
OWNER'S approval before proceeding with any additional services. Additional
Services, if authorized, shall be invoiced per Schedule of Charges attached.
Upon authorization from the OWNER, WFN shall proceed with services outlined in
Attachment SC. Monthly payment requests shall be submitted to the OWNER for that
portion of service which has been accomplished as evidenced by monthly statements.
Final payment for the services shall be due upon the completion of service.
