R2003-0191 12-08-03 RESOLUTION NO. R2003-191 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, DECLARING ITS INTENT TO ABANDON AND SELL FUTURE SURPLUS RIGHT-OF-WAY CREATED AS A RESULT OF THE CULLEN EXTENSION PROJECT. WHEREAS, in consideration for Fire Interests, Ltd, a Texas Limited Partnership (Developer), acceptance of the City's offer to acquire Parcel 10 of the Cullen Extension Project (the Project), the City desires to declare its intention regarding sale of surplus right-of-way upon completion of the Project; and WHEREAS, upon completion of the Project, portions of the existing Old Chocolate Bayou Road right-of-way will be surplus, and the City plans to use its best effort to abandon said surplus right-of-way while simultaneously retaining a utility easement on the same; and WHEREAS, abandonment of the surplus right-of-way will involve the City acting as "Petitioner" in accordance with City of Pearland Ordinance No. 788 and disposing of the surplus right-of-way consistent with the terms of Local Government Code Section 272.001 (a) (2); and WHEREAS, upon the future abandonment of the surplus right-of-way, City plans to use its best effort to sell to Developer the property depicted as Tract A on Exhibit 1 attached hereto; and WHEREAS, in the event City purchases the .498 acre parcel, described as the Milstead Southeast Remainder Tract, and upon abandonment of the surplus right-of-way, City plans to use its best effort to sell to Developer the property depicted as Tract B on Exhibit 1 attached hereto; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: RESOLUTION NO. R2003-191 Section 1. That the City Council hereby declares its intent to abandon and sell future surplus right-of-way created as a result of the Cullen Extension Project in accordance with the terms of this resolution.
