AN ORDINANCE AMENDING CHAPTER 28, SECTION 28-6(a),
ENTITLED HOMESTEAD EXEMPTION, OF THE CODE OF ORDINANCES
OF THE CITY OF PEARLAND, TEXAS, BY CHANGING THE HOME-
STEAD EXEMPTION AMOUNT AS AUTHORIZED BY V.T.C.A. TAX
CODE, SECTION 11.13; AND PROVIDING FOR CODIFICATION;
FOR A SEVERABILITY CLAUSE AND AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND,
TEXAS:
Section 1. That Chapter 29. Section 28-6, entitled Home-
stead Exemption of the Code of Ordinances of the City of Pear -
land, Texas, be and the same is hereby amended to read as fol-
lows:
"Sec. 28-6. Homestead Exemption
(a) From and after January 1, 1990, Twenty -Five Thousand
and No/100 ($25,000.00) Dollars of the Assessed Value of resi-
dence homesteads of the owner or owners who have attained the age
of sixty-five (65) years or older, shall be exempt from all
taxation as authorized by V.T.C.A. Tax Code, Section 11.13;
provided, however, that where the ad valorem tax has heretofore
been pledged for the payment of any debt, the taxing officers of
the City shall have the authority to continue to levy rate as the
tax so pledged until the debt is discharged, if the cessation of
the levy would impair the obligation of the contract by which the
debt was created.
Section 2. It is hereby declared to be the intention of the
Council that the sections, paragraphs, sentences, clauses, and
phrases of this Ordinance are severable, and if any section,
paragraph, sentence, clause or phrase of this Ordinance shall be
declared unconstitutional or invalid by any judgment or decree of
a Court of competent jurisdiction, such unconstitutionality or
invalidity shall not affect any other remaining section, para-
graph, sentence, clause or phrase of this Ordinance, and the City
Council hereby declares it would have passed the remaining por-
tions even though it had known the affected parts would be held

unconstitutional.
Section 3. It is the intention of the City Council that
this amendment when passed and approved, shall become incorporat-
ed in and be a part of the Code of Ordinances of the City of
Pearland, Texas.
Section 4. This Ordinance shall take effect and be in
force from and after the taxable year of 1989.
