Ord. 0246-002 08-27-73ORDINANCE NO. 246-2 AN ORDINB~NCE OF THE CITY OF PEARLAND, TEXAS, AMENDING ORDINANCE NO. 246, KNOWN AS THE LAND USE AND URBAN DEVELOPMENT ORDINANCE OF THE CITY OF PEARLA=ND, TEXAS; PNDVIDING FOR A~4END~4T OF THE LAND USE DISTRICT 5~%P, PRO- V/DING AN ~.'~'~'~JI'IVE DATE AND CONTA_INING OTHER PROVISIONS RE~ATING TO THE SUBJECT. WHEREAS, VERNON W. HALIK, as owner of the property, filed July 5, 1973, an application for amandmant pursuant to Article IV Section 00-10 of the Land Use and Urban Development Ordinanc~ of the City, for the approwhl of a change in land use all as provided for in Section 00-10, said property being legally described in the original application for amendment attached hereto, and made a part hereof for all purposes, as Exhibit A; and WHEREAS, on the 20th day of July, 1973, a public hearing was held, pursuant to the call of the City Council, before the Planning and Zoning Commission of the City of Pearland, Texas, all in accordance with the pro- visions of Article IV Section 10-2 (4) and (5) of Ordinance No. 246; and ~REAS, on the 23rd day of July, 1973, the Planning and Zou_ing Con~ission of the City, submitted their report and reccmmendation to the City Council regarding the proposed amendment application of Vernon W. Halik, whereby they re~ed and approved a change of classification for the properties described in Exhibit A, from their existing classification of "PU" to ~a !'C" District; and WHEREAS, upon receipt of the report of the Planning and Zoning Commission, the City Council thereafter gave notice of a public h~aring to be held on August 13, 1973, at 7:30 P. M. by publication in the official newapaper of the City, the affidavit of publication being attached hereto and made a part hereof for all purposes, as Exhibit B, said call and notice being in strict conformity with the provisions of Article IV Section 10-2 (6) of Ordinance No. 246; and WHEREAS, a public hearing was held on the application of Vernon W. Halik, by the City Council at its regular meeting held on August 13, 19737 WHEREAS, the City Council having fully heard the testimony and arguments of all interested parties and being fully advised in the premises, finds that in the case of the application of Vernon W. Halik, facts were presented which, in the judgment of the City would justify the approval of said application, it is therefore, ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: I The following described property located within the corporate city limits of the City of Pearland, Texas, record owner being Vernon W. Halik, presently classified as ~ Planned Unit Development District is hereby for all purposes changed and re-classified as a Commercial District, to-wit: BEGINNING at the Northwest corner of Lot 52, in Section No. 2, H. T. & B. R. R. Survey, Certificate 361, Abstract No..542 in Brazoria County, Texas, at its intersection with the East right-of-way line of State Highway 35; THENCE, South 89 59' East along the North boundary line of Lot 52, a distance of 250... feet to a point; Said point being the PLACE OF BEGINNING of this field note description. THENCE, continuing South 89 59' East along the North boupd*~y line of Tract 52, a distance of 1,075. feet to a point for corner; THF~NCE, due South a distance of 318.06 feet to a point for THENCE, North 89 59' West a distance of 1,075 point; feet to a THENCE, due North 318.06 feet to the place of ~EGIIkINqLNG, and containing 10.58 acres, more or less. II The City Secretary is hereby directed to cause to be prepared an amendment to the official Land Use District ~Map of the City, pursuant to the provisions of Section 00-5 of Ordinance No. 246, and consistent with the approval herein granted for the re-classification of the hereinabove described property.
