AN ORDNANCE OF THE CITY OF PEARLAND, TEXAS,
AMENDING ORDINANCE NO. 246, KNOUN AS THE
LAND USE AND URBAN DEVELOPMaNT ORDINANCE OF
TEE CITY OF PEARLI%ND, TEXAS; PROVIDING FOR
» ENDic 'T OF THE LAND USE DISTRICT NAP, PRO-
VIDING AN EFFECTIVE DATE AND CONTAINDIG
OT` ER PROVISIONS RELATING TO THE SUBJECT.
WHEREAS, DONALD E. HALIK and NARGAP. T D. HALIK, owners of property,
filed July 5, 1973, an application for amendment pursuant to Article IV
Section 00-10 of the rand Use and Urban Development Ordinance of the
City, for the approval of a change in land use all as provided for in
Section 00-10, said property being legally described in the original
application for amendment attached hereto, and made a part hereof for all
purpozcc, as exhibit A; and
WHEREAS, on the 20th day of July, 1973, a public hearing was held,
pursuant to the call of the City Council, before the Planning and Zoning
Commission of the City of Pearland, Texas, all in accordance with the
provisions of Article IV Section 10-2 (4) and (5) of Ordinance No. 246;
and
WHE,R'EAS, on the 23rd day of July, 1973, the Planning and Zoning
Commission of the City, submitted their report and recommendation to the
City Council regarding the proposed amendment application of Donald E.
Halik and Margaret D. Halik, whereby they recommended and approved a
change of classification for the properties described in Exhibit A,
from their existing classifications, "PU" to "C" and "PU" to an "M-1"
District.
WHEREAS, upon receipt of the report of the Planning and Zoning
Commission, the City Council thereafter gave notice of a public hearing
to h° held on August 13, 1973, at 7:30 P. M. by publication in the official
newspaper of the City, the affidavit of publication being attached hereto
and made a part hereof for all purposes, as Fthibit B, said call and
notice being in strict conformity with the provisions of Article IV
Section 10-2 (6) of Ordinance No. 246; and
WHEREAS, a public hearing was held on the application of Donald
E. Ralik and Margaret D. Halik, by the City Council at its regular
*meeting held on August 13, 1973; and
VHEPFAS, the City Council having fully heard the testimony and
arguments of all interested parties and being fully advised in the
premises, finds that in the case of the application Donald E. Malik and
Margaret D. Halik, facts were presented which, in the judgment of the
City would justify the approval of said application, it is therefore,
ORDAINED BY THE CITY COUNCIL OF THE CITY OF PFLE&RLAND, TEXAS:
The following described property located within the cot, rate
City limits of the City of Pearland, Texas, record owners being Donald
E. Halik and Margaret D. Halik, presently classified as a Planned Unit
Development is hereby for all purposes changed and re-classified as
(1) Commercial District (C) and (2) Group "A" Light Industrial Uses
M-1, to wit:

line of State Highway 35, a distance of 350.22 feet
to a point for corner;

Brazoria County, Texas, at its intersection with the East

THENCE, South 00° 06' West along the East right-of-
way line of State Highway 35, a distance of 350.22 feet to
a point for corner;
THENCE, East 425 feet to a point. Said point being
the PLACE OF BEGINNING of this field note description;
THENCE, continuing East a distance of 750 feet to a
point for corner;
THENCE, North 000 06' East 310.22 feet for a point for
corner;
THENCE, West and parallel to the North property line
of Tract 37, 750 feet to a point for corner;
THENCE, South 00° 06' West 310.22 feet to the PLACE OF
BEGINNING, and containing 5.34 acres, more or less.
II.
The City Secretary is hereby directed to cause to be prepared an
amendment to the official Land Use District Map of the City, pursuant to
the provisions of Section 00-5 of Ordinance No. 246, and consistent with
the approval herein granted for the re-classification of the hereinabove
described property.
• III.
This ordinance shall me effective after its passage and approval
upon second and final reading.
