Ord. 0246-007 12-09-74ORDINANCE NO. 246- 7 AN ORDINANCE OF THE CITY OF PEARLAND, TEXAS, AMENDING ORDINANCE NO. 246, KNOWN AS THE LAND USE ANQ' MAN DEVELOPMENT ORDINANCE OF THE CITY OF PEARLAN10, TEXAS; PROVIDING FOR AMENDMENT OF THE LAND USE DISTRICT MAP, PRO- VIDING AN EFFECTIVE DATE AND CONTAINING OTHER PROVISIONS RELATING TO THE SUBJECT. WHEREAS, M. R. KRUEMCKE, JR., Trustee and owner of the prop- erty, filed July 16 , 1974, an application for amendment pur- suant to Article IV Section 00-10 of the Land Use and Urban Develop- ment Ordinance of the City, for the approval of a change in land use all as provided for in Section 00-10, said property being legally de- scribed in the original application for amendment attached hereto, and made a part hereof for all purposes, as Exhibit A; and WHEREAS, on the 6thday of August , 1974, a public hearing was held, pursuant to the call of the City Council, before the Planning and Zoning Commission of the City of Pearland, Texas, all in accord- ance with the provisions of Article IV Section 10-2 (4) and (5) of Ordinance No. 246, and WHEREAS, on the 8th day of August , 1974, the Planning and Zon- ing Commission of the City, submitted their report and recommendation to the City Council regarding the proposed amendment application of M. R'. KRUEMCKE, JR., Trustee, whereby they recommended and approved a change of classification for the properties described in Exhibit A, from their existing classification of "PU" to a "M-1" District; and WHEREAS, upon receipt of the report of the Planning and Zon- ing Commission, the City Council thereafter gave notice of a public hearing to be held on September 4 , 1974, at 8:30P.M. by publica- tion in the official newspaper of the City, the affidavit of publica- tion being attached hereto and made a part hereof for all purposes, as Exhibit B, said call and notice being in strict conformity with the provisions of Article IV Section 10-2 (6) of Ordinance No. 246i and WHEREAS, a public hearing was held on the application of M. R. KRUEMCKE, JR., Trustee, by the City Council at its regular meeting held on September WHEREAS, the City Council having fully heard the testimony and argument of all interested parties, and having been advised that the property subject to application No. 12 is contiguous to and/or a part of other property belonging to the applicant which has heretofore been classified as M-1 District, finds that in the case of the appli- cation of M.•R. KRUEMCKE, JR., Trustee, sufficient facts were present- ed which, in the judgment of the City Council would justify the appro- val of said application, thus providing continuity in and to said gen- eral area and in keeping with the comprehensive plan for the City of Pearland, Texas, it is therefore, ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: I The following described property located within the corporate city limits of the City of Pearland, Texas, record owner being M. KRUEMCKE; JR., Trustee, presently classified as a Planned Unit Develop- mentDistrict is hereby for all purposes changed and re-classified as a 11-1 Industrial District - Performance Standard Class A, to -wit: 1.15 ACRES OUT OF 21.44 ACRES, BEING LOT 29, OF THE W.
