Ord. 0246-014 03-08-76ORDINANCE NO. 246-14 AN ORDINANCE OF THE CITY OF PEARLAND, TEXAS, AMENDING ORDINANCE NO. 246, KNOWN AS THE LAND USE AND URBAN DEVELOPMENT ORDINANCE OF THE CITY OF PEARLAND, TEXAS; PROVIDING FOR AMENDMENT OF THE LAND USE DISTRICT MAP, PROVIDING AN EFFECTIVE DATE AND CONTAINING OTHER PRO- VISIONS RELATING TO THE SUBJECT. WHEREAS, Mr. James Lewis Martin, as owner of the property, filed December 16, 1975, an application for amendment pursuant to Article IV, Section 00-10 of the Land Use and Urban Development Ordinance of the City, for the approval of a change in land use all as provided for in Section 00-10, said property being legally de scribed in the original application for amendment attached hereto, and made a part hereof for all purposes, as Exhibit A; and WHEREAS, on the 6th day of January, 1976, a public hearing was held, pursuant to the call of the City Council, before the Planning and Zoning Commission of the City of Pearland, Texas, all in accordance with the provisions of Article 9 IV, Section 10-2 (4) and (5) of Ordinance No. 246; and WHEREAS, on the 8th day of January, 1976, the Planning and Zoning Commission of the City of Pearland, Texas, submitted their report and recommenda- tion to the City Council regarding the proposed amendment application of Mr. James Lewis Martin, whereby they recommended and approved a change of classification for the property described in Exhibit A from its existing classification "PU" (Planned Unit) to "C" (Commercial) District; and WHEREAS, upon receipt of the report of the Planning and Zoning Commission, the City Council thereafter gave notice of a public hearing to be held on February 9, 1976 at 7:30 P. M. by publication in the official newspaper of the City, the affidavit of publication being attached hereto and made a part for all purposes, as Exhibit B, said call and notice being in strict conformity with the provisions of Article IV Section 10-2 (6) of Ordinance No. 246; and m WHEREAS, a public hearing was held on the application of Mr. James Lewis Martin, by the City Council at a public hearing held on February 9, 1976; and WHEREAS, the City Council having fully heard the testimony and arguments of all interested parties and being fully advised in the premises, finds that in the case of the application of Mr. James Lewis Martin, facts were presented which, in the judgement of the City would justify the approval of said application, it is therefore, ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: I. The following described property located within the corporate City limits of the City of Pearland, Texas, record owner being Mr. James Lewis Martin, presently classified as a Planned Unit Development District is hereby for all purposes changed and re-classified as Commercial: All that certain tract or parcel of land being 4.0 acres out of the Southeast corner of the East 9.85 acres of land (as conveyed to Kenneth L. Tinkle by Ione Kresse Ramin) of the West 19.85 acres of Lot 35, in H. T. & B. R. R. Co., Survey No. 4, Abstract 543, as shown on map of Zychlinski Subdivision, as recorded in Volume 29, page 43, of the Deed Records of Brazoria County, Texas, said deed of 9.85 acres dated January 14, 1960, and recorded in Volume 759, page 127, de- scribed by metes and bounds as follows: BEGINNING at the Southeast corner of said 9.85 acres, a point in the center line of county road; THENCE, West with center line of road a distance of 369 feet to point for corner; THENCE, North 1° 08 min. West at 30 feet to a 3/4 inch iron pipe and continue same course a total distance of 472.2 feet to a 3/4 inch iron pipe; THENCE, East a distance of 369 feet to a 3/4 inch iron pipe in a chain link fence; THENCE, South 1° 08 min. East at 442.2 feet pass a 1" pipe at corner of chain link fence and continue same course a total distance of 472.2 feet to PLACE OF BEGINNING. II. The City Secretary is hereby directed to cause to be prepared an amendment to the official Land Use District Map of the City, pursuant to the provisions of Section 00-5 of Ordinance No. 246, and consistent with the approval herein granted for the re-classification of the hereinabove described property. III. This ordinance shall become effective after its passage and approval upon second and final reading. PASSED AND APPROVED ON FIRST READING this J, day of ilY 1976.
