2010-01-18 CITY COUNCIL PUBLIC HEARING MEETING MINUTES 6:30 MINUTES OF THE JOINT PUBLIC HEARING OF THE CITY COUNCIL AND PLANNING AND ZONING COMMISSION OF THE CITY OF PEARLAND, TEXAS, HELD ON JANUARY 18, 2010 AT 6:30 P.M., IN THE COUNCIL CHAMBERS, CITY HALL, 3519 LIBERTY DRIVE, PEARLAND, TEXAS CALL TO ORDER Mayor Tom Reid and P &Z Chairperson Jerry Koza, Jr. called the public hearing to order at 6:38 p.m. with the following present: Mayor Tom Reid P &Z Chairperson Jerry Koza, Jr. Mayor Pro -Tem Felicia Kyle P &Z Commissioner Henry Fuertes Council Member Kevin Cole P &Z Commissioner Neil West Council Member Steve Saboe P &Z Commissioner Susan Sherrouse Council Member Scott Sherman P &Z Commissioner Ron Capehart Council Member Woody Owens Also in attendance: City Attorney Darrin Coker, Assistant City Manager Mike Hodge, Assistant City Manager Jon Branson, City Engineer Narciso Lira, Planning Director Lata Krishnarao, Senior Planner Angela Gantuah, Planning Technician Ian Clowes, and Planning Office Coordinator Judy Krajca Senior Planner Angela Gantuah explained the Joint Public Hearing process for the attending public, and explained that the Planning Zoning Commission meeting will immediately follow the Joint Public Hearing. Mayor Tom Reid called to order the Public Hearing for Zone Change No. 2009 -15Z at 6:42 p.m. ZONE CHANGE NO. 2009 -15Z A request of Ron Jackson with Curry Architecture, applicant for Ross Maccammon, owner, for a change in zoning from the Single Family Residential -1 (R -1) Zoning District to the Planned Development Multi Family (PD -MF) Zoning District, on the following described property, to wit: Legal Description: Being a tract of land approximately 9.5171 acres in the W.D.C. Hall League, Abstract No. 70, Brazoria County, Texas and being the residue of that tract sold by None Gay Carr to Ross A. McClendon, as described in deed recorded under Brazoria county Clerk's file No. 95- 022654. General Location: Located at 2810 Dixie Farm Road, Pearland, Texas P &Z Chairperson Jerry Koza, Jr. read the purpose into the record. Senior Planner Angela Gantuah presented a detailed staff report and PowerPoint presentation, going over the ten outstanding items listed in the staff report: JPH Minutes 01/18/10 Page 1 of 4 1) Parking Deviation 2) Evacuation Plan 3) Elevator 4) Common Open Space 5) Impervious Land 6) Wording "conceptual" 7) Deviation of Facade in Corridor Overlay District 8) 6 ft. fence Need to address masonry fence requirement or deviation needs to be requested 9) Proposed Setbacks Parking 10) Future Parking Spaces Staff stated that if the comments are addressed, staff recommends approval of the zone change if all ten (10) items are addressed. Of the Public Comment forms received, only 3 were within the 200 feet radius. Mr. Ron Jackson of Curry Architecture, 471 High Street SE, Suite 10, Salem, OR spoke and presented a detailed PowerPoint. There were numerous people present to speak against the Zone Change. Diane Leaverton of 2310 Buckholt St., Pearland, TX spoke in opposition stating she felt this was the wrong use for the land. Ms. Leaverton also stated she had submitted a very lengthy letter to staff outlining her concerns. Ms. Leaverton said she appreciated the clarification from Mr. Jackson about Harvest Development verses Holiday Retirement. She expressed concern with why some of the property owners only have just received their notification letter the week before the meeting; and expressed concern with the fire lane. Ms. Leaverton stated she encourages the City to follow the Master Plan. Greg Nelson of 1617 Pine Crest Drive, Pearland, TX spoke in opposition and expressed concern with the traffic turns in and out of the Retirement Residence. Neil Barnhill of 1813 Oak Lodge Dr., Pearland, TX spoke in opposition stating it would affect value of homes and the noise level would be disturbing to the neighbors. Nancy Kozanecki of 3705 Pine Branch Drive, Pearland, TX spoke in opposition for a lot of the reasons mentioned, and stated she feels this is spot zoning. Gregory Moran of 1506 Sycamore Dr., Pearland, TX spoke in opposition stating he lives at the corner of Sycamore and Dixie Farm. Mr. Moran only received his notice the Friday prior to the meeting. Laura Bryan of 2707 Crane Drive and 2709 Crane Drive spoke in opposition stating drainage is a major issue. JPH Minutes 01/18/10 Page 2 of 4 Mike Leaverton of 2310 Buckholt St., Pearland, TX spoke in opposition and expressed concern with the ingress and egress, along with reiterating some of the same issues as stated by the other speakers in opposition. Council Member Woody Owens stated that at the last meeting in November 2009, neighbors were notified, and a lot are here tonight. Council Member Owens expressed concern with only having one elevator. Council Member Owens stated he would like to see the parking needs addressed as there is too much deviation being requested. The traffic issues still are not addressed. Council Member Owens stated he does not feel this is a good site for this facility. Council Member Scott Sherman stated he concurs with Council Member Owens, and is concerned with the substrate of the fire lane and the traffic. Council Member Sherman would like to see an evacuation plan, and to address the flooding issues. Council Member Felicia Kyle stated this is a major entrance way into the city, and was concerned that the neighbors being notified and receiving their letters late. Council Member Kyle added that she has yet to hear any compelling reason to change the zoning. Council Member Kevin Cole also expressed concern over the late notification letters, and the type of material the roads would be built with. Council Member Cole added that this should be a Master Plan, and that this is not the perfect spot for this facility. Council Member Steve Saboe concurs with the other council members, and stated he was concerned with the relationship between Holiday and Hawthorne. Council Member Saboe added that he is surprised to not see more of the immediate neighbors here tonight. Mayor Tom Reid stated he was concerned with the parking during holidays and lack of response from immediate neighbors. Mayor Reid also expressed concern with the access issue. P &Z Commissioner Henry Fuertes expressed concern over the parking spaces and inquired if this includes parking for staff members. P &Z Commissioner Susan Sherrouse stated she likes the use but is concerned with the parking and traffic generated.
