Ord. 0246-038 02-27-78ORDINANCE'NO."246-38 AN ORDINANCE -OF THE CITY OF PEARLAND, TEXAS, AMENDING ORDINANCE NO. 246, KNOWN -AS THE LAND USE AND URBAN DEVELOPMENT ORDINANCE OF THE CITY OF PEARLAND, TEXAS; PROVIDING FOR AMENDMENT OF THE LAND USE DISTRICT MAP; PROVIDING AN EFFECTIVE DATE AND CONTAINING OTHER PRO- VISIONS RELATING TO THE SUBJECT. WHEREAS, Alvin A. Pampell, as owner of property, filed November 22, 1977, an application for amendment pursuant to Article IV, Section 00-10 of the Land Use and Urban Development Ordinance of the City, for approval of a change in land use all as provided for in Section 00-10, said property being legally described in the original application for amendment attached hereto, and made a part hereof for all purposes, as Exhibit "A"; and WHEREAS, on the 20th day of December, 1977, a public hearing was held, pursuant to the call of the City Council, before the Planning and Zoning Commission of the City of Pearland, Texas, all in accordance with the provisions of Article IV, Section 10-2 (4) and (5) of Ordinance No. 246; and WHEREAS, on the 27th day of December, 1977, the Planning and Zoning Commission of the City, submitted their report and recommendation to the City Council regarding the proposed amendment application of Alvin A. Pampell, whereby they recommended and approved a change of classification for the properties described in Exhibit "A", from their existing classification of General Business to Commercial; and WHEREAS, upon receipt of the report of the Planning and Zoning Commission, the City Council thereafter gave notice of a public hearing to be held on January 23, 1978, by publication in the official newspaper of the City, the affidavit of publication being attached hereto and made a part hereof for all purposes, as Exhibit "B", said call and notice being in strict conformity with the provisions of Article IV, Section 10-2 (6) of Ordinance No. 246; and WHEREAS, a public hearing was held on the application of Alvin A. Pampell, City Council at its regular meeting held on January 23, 1978; and WHEREAS, the City Council having fully heard the testimony and argument of all interested parties, and having been fully advised in the premises, finds that in the case of the application of Alvin A. Pampell facts were presented which, in the judgment of the City would justify the approval of said application, it is therefore, ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: by the The following described property located within the corporate City Limits of the City of Pearland, Texas, recorded owner being Alvin A. Pampell and presently classified as General Business is hereby for all purposes changed and re-classified as Commercial: Tracts 3 and 4, being 0.827 acre, more or less, out of and part of Lot 21, Block 20, and being out of the H.T. & B.R.R. Co. Survey, Section 2, A-542, in Pearland, Brazoria County, Texas, and being more particularly described by metes and bounds as follows: BEGINNING at a 2 inch iron pipe marking the intersection of the West right-of-way line of Main Avenue (Highway 35) having a 100 ft. right-of-way and the North right-of-way line of Pear Street, 60 ft. right-of-way, said 2 inch iron pipe being the Southeast corner of Lot 21, Block 20, Pearland Townsite; THENCE West, along the North right-of-way line of Pear Street, 60 ft. right-of-way 118.56 feet to a 11/2" iron pipe for corner, said 12" iron pipe being in the East right-of-way line of the G.C. $ S.F.R.R., 100 ft. right-of-way; THENCE North 13° 46' 40" W, along the East right-of-way line of the G.C. $ S.F.R.R., 100 ft. right-of-way, 334.24 ft. to a point for corner; THENCE East, 102.96 ft. to a i" iron rod for corner, said z" iron rod being in the West line of Block 20 and also being the Northwest corner of Lot 12, Block 20, Pearland Townsite; THENCE South 13° 46' 40" E, along the West line of Block 20, 235.41 ft. to a 1" iron rod for corner; THENCE East, 39.12 ft. to a 1.5" iron rod for corner, said 2" iron rod being in the West right-of-way line of Main Avenue (Highway 35), 100 ft. right-of-way; THENCE South, along the West right-of-way line of Main Avenue (Highway 35) 100 ft. right-of-way and the East line of Lot 21, Block 20, 96.0 ft. to the PLACE OF BEGINNING. II. The City Secretary is hereby directed to cause to be prepared an amend- ment to the official Land Use District Map of the City, pursuant to the provisions of Section 00-5 of Ordinance No. 246, and consistent with the approval herein granted for the re-classification of the hereinabove described property.
