Ord. 0246-041 05-08-78ORDINANCE NO. 246-41 AN ORDINANCE OF THE CITY OF PEARLAND, TEXAS, AMENDING ORDINANCE NO. 246, KNOWN AS THE LAND USE AND URBAN DEVELOPMENT ORDINANCE OF THE CITY OF PEARLAND, TEXAS; PROVIDING FOR AMENDMENT OF THE LAND USE DISTRICT MAP; PROVIDING AN EFFECTIVE DATE AND CONTAINING OTHER PRO- VISIONS RELATING TO THE SUBJECT. WHEREAS, C. R. Hackney, Jr., as owner of property, filed January 20, 1978, an application for amendment pursuant to Article IV, Section 00-10 of the Land Use and Urban Development Ordinance of the City, for approval of a change in land use all as provided for in Section 00-10, said property being legally described in the original application for amendment attached hereto, and made a part hereof for all purposes, as Exhibit "A"; and WHEREAS, on the 28th day of February, 1978, a public hearing was held, pursuant to the call of the City Council, before the Planning and Zoning Commission of the City of Pearland, Texas, all in accordance with the provisions of Article IV, Section 10-2 (4) and (5) of Ordinance No. 246; and WHEREAS, on the 13th day of March, 1978, the Planning and Zoning Commission of the City, submitted their report and recommendation to the City Council regarding the proposed amendment application of C. R. Hackney, Jr., whereby they recommended and approved a change of classification for the prop- erties described in Exhibit "A", from their existing classification of Planned Unit to Commercial; and WHEREAS, upon receipt of the report of the Planning and Zoning Commission, the City Council thereafter gave notice of a public hearing to be held on April 17, 1978 by publication in the official newspaper of the City, the affidavit of pub- lication being attached hereto and made a part hereof for all purposes, as Exhibit "B", said call and notice being in strict conformity with the provisions of Article IV, Section 10-2 (6) of Ordinance No. 246; and WHEREAS, a public hearing was held on the application oft. R. Hackney, i Jr., by the City Council at its special meeting held on April 17, 1978; and WHEREAS, the City Council having fully heard the testimony and argument of all interested parties, and having been fully advised in the premises, finds that in the case of the application of C. R. Hackney, Jr., facts were presented which, in the judgment of the City would justifythe approval of said application, it is therefore, ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: I. The following described property located within the corporate City Limits of the City of Pearland, Texas, recorded owner being C. R. Hackney, Jr., and presently classified as Planned Unit is hereby for all purposes changed and re-classified as Commercial: . , A. D., 1978. A Tract of Land out of Lots 1 through 11 of the George W. Jenkins Subdivision, as recorded in Volume 2, Page 20 of the Plat Records of Brazoria County, Texas, located in the Perry $Austin League, Abstract 111, Brazoria County, Texas, being more particularly described as follows: BEGINNING at a point in the Northeast right-of-way line of State Highway F.M. 518 and the South corner of Lot 11; THENCE N. 30° 23' 18" East a distance of 263.12 feet to point for corner, said point being the centerline of the meanders of Mary's Creek; THENCE Northwesterly along the meanders of the centerline of Mary's Creek approximately 1,311 feet across Lots 11, 10, 9, 8, 7, 6, 5, 4, 3, 2, $ 1 to a point for corner. Said point also being in the Southeasterly right-of-way line of Longwood Drive; THENCE S. 45° 10' 38" West a distance of 535.79 feet along the Southeasterly right-of-way line of Longwood Drive to a 1.1 inch iron rod, at the Southwest corner of Lot 1 to a point for corner. Said point for corner also being in the Northeast right-of-way line of State Highway F.M. 518; THENCE S. 59° 36' 42" East a distance of 1,203.07 feet along the North right-of-way line of F.M. 518 to the PLACE OF BEGINNING containing 11 acres more or less. II. The City Secretary is hereby directed to cause to be prepared an amend- ment to the official Land Use District Map of the City, pursuant to the provisions of Section 00-5 of Ordinance No. 246, and consistent with the approval herein granted for the re-classification of the hereinabove described property.
