AN ORDINANCE OF THE CITY OF PEARLAND, TEXAS, AMENDING
ORDINANCE NO. 246, KNOWN AS THE' LAND USE AND URBAN
DEVELOPMENT ORDINANCE OF THE CITY OF PEARLAND, TEXAS;
PROVIDING FOR AMENDMENT OF THE LAND USE DISTRICT MAP;
PROVIDING AN EFFECTIVE DATE AND CONTAINING OTHER PRO-
VISIONS RELATING TO THE SUBJECT.
WHEREAS, Aaron Pasternak, Trustee, an owner of property, filed February
2, 1978, an application for amendment pursuant to Article IV, Section 00-10 of
the Land Use and Urban Development Ordinance of the City, for approval of a change
in land use all as provided for in Section 00-10, said property being legally
described in, the original application for amendment attached hereto, and made a
part hereof for all purposes, as Exhibit "A'; and
WHEREAS, on the 4th day of April, 1978, a public hearing was held,
pursuant to the call of the City Council, before the Planning and Zoning Commission
of the City of Pearland, Texas, all in accordance with the provisions of Article
IV, Section 10-2 (4) and (5) of Ordinance No.246; and
WHEREAS, on the loth day of April, 1978, the Planning and Zoning Commission
of the City, submitted their report and recommendation to the City Council regarding
the proposed' amendment application of Aaron Pasternak, Trustee, whereby they denied
the application as submitted and, recommended that the application be amended to
reflect a change of classification from Planned Unit to General Business; and
WHEREAS, upon receipt of the report of the Planning and Zoning Commission,
the City Council thereafter gave notice of a public hearing to be held on May 8,
1978, by publication in the official newspaper of the City, the affidavit of pub-
lication being attached hereto and made a part hereof for all purposes, as Exhibit
"B", said call and notice being in strict conformity with the provisions of Article
IV, Section 10-2, (6) of Ordinance No. 246; and
WHEREAS, a letter dated: April 10, 1978, was received by the City Council
from Aaron Pasternak's Attorney, James G. Cowen, requesting that the application be
amended to reflect a change of classification from Planned Unit to General Business,
said letter being attached hereto and made a part hereof for all purposes, as
Exhibit "C"; and
WHEREAS,a public hearing was held on the application of Aaron Pasternak,
Trustee, by the City Council at its regular meeting held on May 8, 1978; and
WHEREAS, the City Council having fully heard the testimony and argument
of all interested parties, and having been fully advised in the premises, finds
that in the case of the application of Aaron Pasternak, Trustee, facts were
presented which, in the judgment of the City would justify the approval of said
application, it is therefore,
ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS:
I.
The following described property located within the corporate City Limits
of the City of Pearland, Texas, recorded owner being Aaron Pasternak, Trustee, and
presently classified as Planned Unit is hereby for all purposes changed and re-
classified as General Business:
FIELD NOTES on 3.827 Acres of Land, out of the Aaron Pasternak
313 Acre Tract in the W.D.C. Hall Survey, Abstract 70, Brazoria
County, Texas.
BEGINNING at the intersection of the southwest right-of-way line of
F.M. 518(East Broadway) and the northwest line of Liberty Drive;
THENCE N. 66° 49' 20" W. along the southwest right-of-way line of
F.M. 518 (East Broadway) a distance of 550.0 feet to a i inch iron
rod for the PLACE OF BEGINNING, and the most easterly corner of
this tract being described;
THENCE S. 41° 31' 50" W. a distance of 276.82 feet to a inch iron
rod for the most southeasterly corner of this tract being described;
THENCE N. 66° 56' 42" W. a distance of 634.40 more or less, to a
point in the most northwesterly line of said 313 acre Pasternak.

THENCE N. 41° 31' 25" E. along said northwesterly line of 313 acre
Pasternak Tract a distanceof 277.09 feet more or less to a point
in the southwest right-of-way line of F.M. 518 (East Broadway);
THENCE S. 66° 56' 42" E. along said southwest right-of-way line of
F.M. 518 a distance of 513.10 feet more or less to the PLACE OF
BEGINNING and containing 3.827 acres of land, more or less.

County, Texas.
BEGINNING at the intersection of the southwest right-of-way line
of F.M. 518 (East Broadway) and the northwest right-of-way line of
Liberty Drive;
THENCE S. 66° 49' 34" E. along said southwest right-of-way line of
F.M. 518 a distance of 63 feet to a point, said point being on the
intersection of the southwest right-of-way line of F.M. 518 and the
southeast right-of-way line of Liberty Drive, and being the PLACE
OF BEGINNING of this tract being described;
THENCE continuing S. 66° 49' 34" E. along said southwest right-of-
way line of F.M. 518 a distance of 1,448.17 feet more or less, to
a point, said point being the intersection of the southwest right-
of-way line of F.M. 518 and the most easterly corner of this tract
being described, and the most northerly corner of the Creek View
Subdivision;
THENCE S. 42° 17' 32" W. along the said southeast boundary of the
313 acre Pasternak Tract and the northwest boundary of the Creek
View Subdivision a distance of 1,151.07 feet more or less to a point
for corner, said point being the most southerly point of this tract
being described and the most easterly point of the Pearland Inde-
pendent School District 20± Acre Tract;
THENCE N. 47° 42' 28" W. along the northeast boundary of the
Pearland Independent School District 20± Acre Tract a distance of
1,000.75 feet more or less to a point for corner, said point being
the most northeasterly point of the common boundary of said Pearland
Independent School Tract, and interior corner of this tract being
described;
THENCE N. 47° 44' W. along the northeast boundary of said City of
Pearland 7.298 acre tract a distance of 358.55 feet to a point for
corner, said point being in the southeast right-of-way line of
Liberty Drive, and the most westerly corner of this tract being
described;
THENCE N. 41° 31' 50" E. along said southeast right-of-way line of
Liberty Drive a distance of 676.98 feet more or less to the PLACE
OF BEGINNING, and containing 28.638 Acres of Land, more or less.
II.
The City Secretary is hereby directed to cause to be prepared an amend-
ment to the official Land Use District Map of the City, pursuant to the provisions
of Section 00-5 of Ordinance No. 246, and consistent with the approval herein
granted for the re-classification of the hereinabove described property.
This Ordinance shall become effective after its passage and approval
upon second and final reading.
