Ord. 0246-055 01-08-78ORDINANCE NO. 246-55 AN ORDINANCE OF THE CITY OF PEARLAND, TEXAS, AMENDING ORDINANCE NO. 246, KNOWN AS THE LAND USE AND URBAN DEVELOPMENT ORDINANCE OF THE CITY OF PEARLAND, TEXAS; PROVIDING FOR AMENDMENT OF THE LAND USE DISTRICT MAP; PROVIDING AN EFFECTIVE DATE AND CONTAINING OTHER PRO- VISIONS RELATING TO THE SUBJECT. WHEREAS, South Corridor Two, Ltd., as owner of property, filed October 13, 1978, an application for amendment pursuant to Article IV, Section 00-10 of the Land Use and Urban Development Ordinance of the City, for approval of a change in land use all as provided for in Section 00-10, said property being legally described in the original application for amendment attached hereto, and made a part hereof for all purposes, as Exhibit "A"; and WHEREAS, on the 7th day of November, 1978, a public hearing was held, pursuant to the call of the City Council, before the Planning and Zoning Commission of the City of Pearland, Texas, all in accordance with the provisions of Article IV, Section 10-2 (4) and (5) of Ordinance No. 246; and WHEREAS, on the 13th day of November, 1978, the Planning and Zoning Commission of the City, submitted their report and recommendation to the City Council regarding the proposed amendment application of South Corridor Two, Ltd. whereby they recommended and approved a change of classification for the property described in Exhibit "A", from its existing classification of Planned Unit to Commercial; and WHEREAS, upon receipt of the report of the Planning and Zoning Commission, the City Council thereafter gave notice of a public hearing to be held on December 11, 1978 by publication in the official newspaper of the City, the affidavit of publication being attached hereto, and made a part hereof for all purposes, as Exhibit "B", said call and notice being in strict conformity with the provisions of Article IV, Section 10-2 (6) of Ordinance No. 246; and WHEREAS, a public hearing was held on the application of South Corridor Two, Ltd. by the City Council at its regular meeting held on December 11, 1978; and WHEREAS, the City Council having fully heard the testimony and argument of all interested parties, and having been fully advised in the premises, finds that in the case of the application of South Corridor Two, Ltd. facts were presented which, in the judgment of the City would justify the approval of said application, it is therefore, ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: I. The following described property located within the corporate City Limits of the City of Pearland, Texas, recorded owner being South Corridor Two, Ltd. and presently classified as Planned Unit is hereby for all purposes changed and re-classified as Commercial: A tract of land being 6.8639 acres, more or less, out of Lot 75 of the George W. Jenkins Subdivision as recorded in Volume 79, Page 616 of the Brazoria County Plat Records and being out of the W.D.C. Hall Survey, Abstract 70, and being more particularly described by metes and bounds: C Mayor, City of Pearland, Texas PASSED AND APPROVED ON SECOND AND FINAL READING this BEGINNING at the South corner of the herein described tract, said beginning being North 44° 47' 32" West a distance of 306.55 feet from the South corner of Lot 75 and East corner of Lot 76; THENCE North 44° 47' 32" West along the Southerwesterly line of Lot 75 a distance of 702.23 feet to a point for the West corner of the herein described tract, in the Southeasterly right-of-way line of Dixie Farm Road, a county road 80,foot wide, and also the Southeasterly line of a 20 foot wide easement conveyed to Brazoria County by instrument dated June 16, 1954, and recorded in Volume 842 on Page 54 of the Deed Records of Brazoria County, Texas; THENCE North 45° 00' 27" East along the Southeasterly right-of- way line of Dixie Farm Road, a distance of 424.73 feet to a point for the North corner of the herein described tract; THENCE South 44° 53' 41" East along the common boundary line of Tract 75 and Tract 74 a distance of 703.49 feet to a point for the East corner of the herein described tract, and also the North corner of a 3.0 acre tract of land conveyed to Phillips Petroleum Company be deed dated May 12, 1964, and recorded in Volume 891 on Page 259 of the Deed Records of Brazoria County, Texas, and by correction deed recorded in Volume 1076 on Page 683 of the Deed Records; THENCE South 45° 10' 38" West along the northwesterly line of the Phillips Petroleum Company 3.0 acre tract a distance of 426.02 feet to the PLACE OF BEGINNING along the common line of Tract 75 and 76. 1I. The City Secretary is hereby directed to cause to be prepared an amend- ment to the official Land Use District Map of the City, pursuant to the provisions of Section 00-5 of Ordinance No. 246, and consistent with the approval herein granted for the re-classification of the hereinabove described property.
