Ord. 0246-067 12-22-80ORDINANCE NO. 246-67 AN ORDINANCE OF THE CITY OF PEARLAND, TEXAS, AMENDING ORDINANCE NO. 246, KNOWN AS THE LAND USE AND URBAN DEVELOPMENT ORDINANCE OF THE CITY OF PEARLAND, TEXAS; PROVIDING FOR AMENDMENT OF THE LAND USE DISTRICT MAP; PROVIDING AN EFFECTIVE DATE AND CONTAINING OTHER PRO- VISIONS RELATING TO THE SUBJECT. WHEREAS, RONALD HAUSMAN filed August 11, 1980, an application for amendment pursuant to Article IV, Section 00-10 of the Land Use and Urban Development Ordinance of the City, for approval of a change in land use all as provided for in Section 00-10, said property being legally described in the original application for amendment attached hereto, and made a part hereof for all purposes, as Exhibit "A"; and WHEREAS, on the 2nd day of September, 1980, a public hearing was held pursuant to the call of the City Council, before the Planning and Zoning Commission of the City of Pearland, Texas, all in accordance with the provisions of Article IV, Section 10-2 (4) and (5) of Ordinance No. 246; and WHEREAS, on the 22nd day of September, 1980, the Planning and Zoning Commission of the City submitted their report and recommendations to the City Council regarding the proposed amendment application of Ronald Hausman, whereby they recommended and approved a change of classification for the property described in Exhibit "A" from its existing classification of Planned Unit and R-2 to Plan Approval,.(A Patio Home Subdivision called Willow Trails)as shown on Exhibit "B" attached; and WHEREAS, upon receipt of the report of the Planning and Zoning Commission, the City Council thereafter gave notice of a public hearing to be held on October 13, 1980, by publication in the official newspaper of the City, the affidavit of publication being attached hereto, and made a part hereof for all purposes, as Exhibit "C", and said call and notice being in strict conformity with the provisions of Article IV, Section 10-2 (6) of Ordinance No. 246; and WHEREAS, a public hearing was held on the application of Ronald Hausman, by the City Council at its regular meeting held on October 13, 1980; and WHEREAS, the City Council having fully heard the testimony and argument of all interested parties, and have been fully advised in the premises, finds that in the case of Application No. 86, Ronald Hausman, facts were presented which, in the judgment of the City would justify the approval of said application, it is therefore ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: The following described property located within the corporate City limits of the City of Pearland, Texas, recorded owner being Ronald Hausman and presently classified as Planned Unit and R-2 are hereby for all purposes changed and reclassified as Plan Approval (See Exhibit "B" attached): Beginning at the Northwest corner of Lot 1, Block 16, of the Annalea Kingspark Section "B" and Whitehall Section "B", a plat recorded in Volume 1616, Page 100, of the Galveston County Map Records, Galveston County, Texas, same corner being also in the Brazoria County and Galveston County Line; THENCE along the common line between Brazoria County and Galveston County and the Westerly line of said Annalea, Whitehall Section "B" and Kingspark Section "B", South 10° 42' 12" West, a distance of 1340.21 feet to a point for corner; THENCE North 79° 17' 48" West, a distance of 300.00 feet to a point for corner; THENCE North 10" 42' 12"East, a distance of 125.44 feet to a point for corner; THENCE North 85° 26' 58" West, a distance of 21.11 feet to a point for corner; corner; corner; corner; corner; corner; corner; THENCE North 77" 1316" West, a distance of 63.99 feet to a point for corner; THENCE North 71° 17' 48" West, a distance of 276.01 feet to a point for corner; THENCE North 65° 29' 33" West, a distance of 132.08 feet to a point for THENCE North 57° 55' 26" West, a distance of 212.91 feet to a point for THENCE South.45o 00' 32" West, a distance of 20.00 feet to a point for THENCE North 44° 59' 28" West, a distance of 180.00 feet to a point for THENCE North 45° 00' 32m East, a distance of 1244 feet to a point for THENCE North 69 47' 38" East, a distance of 260.64 feet to a point for THENCE North 450 00' 32" East, a distance of 390.34 feet to a point for THENCE South 10° 42' 12" West, a distance of 501.66 feet to the PLACE OF BEGINNING and containing within these calls 26.1134 acres or 1,137,500.00 square feet of land.
