Ord. 0246-070 06-22-81ORDINANCE NO. 246-70 AN ORDINANCE OF THE CITY OF PEARLAND, TEXAS, AMENDING ORDINANCE NO. 246, KNOWN AS THE LAND USE AND URBAN DEVELOPMENT ORDINANCE OF THE CITY OF PEARLAND, TEXAS; PROVIDING FOR AMENDMENT OF THE LAND USE DISTRICT MAP; PROVIDING AN EFFECTIVE DATE AND CONTAIN- ING OTHER PROVISIONS RELATING TO THE SUBJECT. WHEREAS, Louis A. Corte, Agent for Owners, Clear Creek Property, Ltd., filed February 13, 1981, an application for amendment pursuant to Article IV, Section 00-10 of the Land Use and Urban Development Ordinance of the City, for approval of a change in the land use all as provided for in Section 00-10, said property being legally described in the original applications for amendment attached hereto, and made a part hereof for all purposes, as Exhibit "A"; and WHEREAS, on the 7th day of April, 1981, a public hearing was held before the Planning and Zoning Commission of the City of Pearland, Texas, all in accordance with the provisions of Article IV, Section 10-2 (4) and (5) of Ordinance No. 246; and WHEREAS, on the loth day of April, 1981, the Planning and Zoning Com- mission of the City submitted their report and recommendation to the City Council regarding the proposed amendment applications of Louis A. Corte, Agent for Owners, Clear Creek Property, Ltd., whereby they recommended and approved a change of classification for the properties described in Exhibit "A" from its existing classification Planned Unit and Pre -Development District to General Business on Application No. 92; and from classification Pre -Development District to Commercial on Application No. 92A; and WHEREAS, upon receipt of the report from the Planning and Zoning Com- mission, the City Council thereafter gave notice of a public hearing to be held on the 26th day of May, 1981, by publication in the official newspaper of the City, the affidavit of publication being attached hereto and made a hereof for all purposes, as Exhibit "B", said call and notice being in strict conformity with the provisions of Article IV, Section 10-2 (6) of Ordinance No. 246; and WHEREAS, a public hearing was held on the applications of Louis A. Corte, Agent for Owners, Clear Creek Property, Ltd., by the City Council at its regular meeting held on May 26, 1981; and WHEREAS, the City Council have fully heard the testimony and argument of all interested parties, having been fully advised in the premises, finds that in the case of the applications of Louis A. Corte, Agent for Owners, Clear Creek Property, Ltd., facts were presented which, in the judgment of the City would justify the approval of said applications, it is therefore, -1- ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: APPLICATION N0. 92 - The following described property located within the corporate City Limits of the City of Pearland, Texas, recorded owner being Clear Creek Property, Ltd. and presently classified as Planned Unit and Pre - Development District is hereby for all purposes changed and re-classified as General Business: A tract of land containing 19.68 acres, out of Lot 63 of the G. W. Jenkins Subdivision of the W.D.C. Hall Survey, Abstract 23, in Harris County, Texas, as recorded in the Map Records of Harris County, Texas, and of the G. W. Jenkins Subdivision of the W.D.C. Hall League, Abstract 70, as recorded in Volume 239, Page 293 of the Plat Records of Brazoria County, Texas, and being more particularly described in metes and bounds as follows: BEGINNING at a point marking the Northeast corner of said Lot 63, same point being the Northeast corner of the herein described tract; THENCE South 45 deg. 00' W 1,370.66 feet to point changing course to South 59 deg. 01' 20" W for a distance of 336.13 feet, to a point for corner; THENCE North 45 deg. 00' W a distance of 431.88 feet to a point for corner; THENCE North 45 deg. 00' E a distance of 1,696.80 feet, to a point for corner; THENCE South 45 deg. 00' E 513.33 feet, to a point for corner and the PLACE OF BEGINNING. APPLICATION N0. 92A - The following described property located within the corporate City Limits of the City of Pearland, Texas, recorded owner being Clear Creek Property, Ltd. and presently classified as Pre -Development District is hereby for all purposes changed and re-classified as Commercial: Lot 61, of the G.W. Jenkins Subdivision of the W.D.C. Hall Survey, Abstract 23, Harris County, Texas, containing 10 acres of land, more or less, and being more particularly described in metes and bounds as follows: BEGINNING at a 2 inch iron rod marking the south corner of the said Lot' 61, at the intersection of the southeasterly line of the G. W. Jenkins Subdivision and the northeasterly line of the aforesaid dedicated roadway, 30 feet wide; THENCE N 45 deg. 00' 00" W, along the southwesterly line of the said Lot 61 on the northeasterly line of the said dedicated roadway, 30 feet wide, a distance of 1026.66 feet to a 2 inch iron road marking the west corner of the said Lot 61, at the east intersection of two dedicated roadways, 30 feet wide; THENCE N 45 deg. 00' 00" E, along the northwesterly line of the said Lot 61, on the southeasterly line of the said dedicated roadway, 30 feet wide, a distance of 424.20 feet to a 2 inch iron rod marking the north corner of the said Lot 61, at the west corner of Lot 60; THENCE S 45 deg. 00' 00" E, along the northeasterly line of the said Lot 61, on the southwesterly line of the aforesaid Lot 60, a distance of 1026.66 feet to a 5/8 inch iron rod marking the east corner of the said Lot 61, at the south corner of the said Lot 60; THENCE S 45 deg. 00' 00" W along the southeasterly line of the said Lot 61, on the southeasterly line of the G. W. Jenkins Subdivision, a distance of 424.20 feet to the PLACE OF BEGINNING. -2- II. The City Secretary is hereby directed to cause to be prepared an amendment to the official Land Use District Map of the City, pursuant to the provisions of Section 00-5 of Ordinance No. 246, and consistent with the approval herein granted for the re-classification of the hereinabove described property.
