Ord. 0246-074 08-24-81ORDINANCE N0. 246-74 AN ORDINANCE OF THE CITY OF PEARLAND, TEXAS, AMENDING ORDINANCE NO. 246, KNOWN AS THE LAND USE AND URBAN DEVELOP- MENT ORDINANCE OF THE CITY OF PEARLAND, TEXAS; PROVIDING FOR AMENDMENT OF THE LAND USE DISTRICT MAP; PROVIDING AN EFFECTIVE DATE AND CONTAINING OTHER PROVISIONS RELATING TO THE SUBJECT. WHEREAS, BERT and FRANCES JAMISON, as owners of the property, filed April 8, 1981, an application for amendment pursuant to Article IV, Section 00-10 of the Land Use and Urban Development Ordinance of the City, for approval of a change in land use all as provided for in Section 00-10, said property being legally described in the original application for amendment attached hereto, and made a part hereof for all purposes, as Exhibit "A"; and WHEREAS, on the 5th day of May, 1981, a public hearing was held before :i the Planning and Zoning Commission of the City of Pearland, Texas, all in accordance with the provisions of Article IV, Section 10-2 (4) and (5) of Ordinance No. 246; and WHEREAS, on the 7th day of May, 1981, the Planning and Zoning Commission of the City submitted their report and recommendation to the City Council regarding the proposed amendment application of BERT and FRANCES JAMISON, whereby they disapproved a change of'classification for the properties described in Exhibit "A", from their existing classification of PU (Planned Unit) to MF (Multi -Family Dwelling District); and WHEREAS, upon receipt of the report of the Planning and Zoning Commission the City Council thereafter gave notice of a public hearing to be held on June 8, 1981, by publication in the official newspaper of the City, the affidavit of publication being attached hereto and made a part hereof for all purposes, as Exhibit "B", said call and notice being in strict conformity with the provisions of Article IV, Section 10-2 (6) of Ordinance No. 246; and WHEREAS, a public hearing was held on the application of BERT and FRANCES JAMISON, by the City Council at its regular meeting held on June 8, 1981; and WHEREAS, the City Council having fully heard the testimony and argument of all interested parties, and having been fully advised in the premises, finds that in the case of the application of BERT and FRANCES JAMISON facts were presented which, in the judgment of the City would justify the approval of said application, and thereby upon a majority vote as required by Ordinance No. 246, the City Council did in all things approve said application, it is therefore ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: The following described property located within the corporate City Limits of the City of Pearland, Texas, recordedowners being BERT and FRANCES JAMISON, and presently classified as PU (Planned Unit) is hereby for all pur- poses changed and re-classified as MF (Multi -Family Dwelling District): A 15.4912 ACRE TRACT BEING All of Tract 43, a Portion of Tract 30 and a Portion of Tract 29, Out of the George W. Jenkins Subdivision, J. F. Perry and E. M. Austin Survey, Abstract 111, Brazoria County, Texas. Said Tract Being Described as follows: BEGINNING at a 3/4 inch iron pipe found for the south corner of Tract 43, George W. Jenkins Subdivision, J. F. Perry and E. M. Austin Survey, Abstract 111, Brazoria County, Texas; THENCE N. 45° 00' W. a distance of 859.51 feet to a a inch iron rod set for corner in the centerline of a 40 foot platted road; THENCE N. 45° 00' E. a total distance of 972.12 feet to a z inch iron rod set for the most northerly corner of this tract being described; THENCE S. 59° 39' 22" E. a distance of 384.02 feet to a 2 inch iron rod set for the most easterly corner of this tract; THENCE S. 27° 47' 09" W. a distance of 593.33 feet to a - inch iron rod set for interior corner; THENCE S. 45° 00' E. a distance of 314.78 feet to a z inch iron pipe found for corner and the east corner of Tract 43; THENCE S. 45° 16' 18" W. along the southeast line of Tract 43, 502.53 feet to the PLACE OF BEGINNING, and containing 15.4912 Acres of Land. . Note: This Tract subject to 20 feet of a 40' platted roadway and Texas Eastern Gas Pipeline Co. Easements of record. II. The City Secretary is hereby directed to cause to be prepared an amend- ment to the official Land Use Distract Map of the City, pursuant to the provisions of Section 00-5 of Ordinance No. 246, and consistent with the approval herein granted for the re-classification of the hereinabove described property.
